Por FactBox Admin

The Plenary of the Osuna City Council has definitively approved the Project for the delimitation of land reserves for possible acquisition to expand the Municipal Land Heritage, intended for the creation of a peri-urban archaeological park in the Alcazaba area. The agreement, adopted in the session of September 28, 2026, is published in the Official Gazette of the Province of Seville No. 200, dated October 15, 2026, pages 47 to 49 (official reference: BOP-SE-2026-200012).
A rural land reserve supported by regional law
The Corporation considers it necessary to carry out the compulsory expropriation of land classified as rural land within the municipal district of Osuna, in accordance with Article 130 of Law 7/2021, of December 1, for the promotion of the sustainability of the territory of Andalusia. The project was drafted by Rafael González del Río, Municipal Architect at the date of signing, and justifies the need for the reserve by indicating that the properties to be delimited are classified as rural land in the current urban planning, the PGOU of Osuna (Subsidiary Norms adapted to the LOUA).
The file, processed under number P2809261005, was initially approved by the Plenary on April 28, 2026, and was subsequently submitted for public review for twenty days via an announcement in the Official Gazette of the Province and on the municipal Transparency Portal, with notification and hearing procedures for the affected owners. For unknown interested parties, notification was carried out via an announcement in the Official State Gazette. On September 10, 2026, the absence of allegations was certified.
The two properties affected by the expropriation
The project delimits two properties for possible acquisition for the municipal land heritage:
- Registered property no. 8,673: 3,208 m², registered in volume 1150, book 620, folio 70, entry 7. Its registered owners are Manuel Gómez Ramírez and Isabel María Santiago Caro, under the community property regime, owners of 100% of the full ownership by a purchase deed granted in Osuna on March 27, 2017. It corresponds to cadastral reference 41068A147000440000JI, arable land, with address at C/ Farfana Baja no. 38 in Osuna. It is subject to a preventive urban planning annotation in favor of the City Council of Osuna, file 578/2023, for fencing works on the property without a license.
- Registered property no. 11,190: 12,616 m², registered in volume 581, book 339, folio 39, entry 4. Its registered owner is Manuel Ramírez Galván, holder of 100% of the full ownership by a deed granted in Osuna on March 24, 1965. It corresponds to cadastral reference 41068A147000550000JA, rural olive grove, with 12,036 m² cadastral area, and its cadastral owners are the Heirs of Manuel Ramírez Galván, with address at C/ Farfana Alta no. 35 in Osuna.
Publication, entry into force, and means of appeal
The agreement is published in accordance with article 70.2 of Law 7/1985, of April 2, Regulating the Bases of the Local Regime, and shall not enter into force until its full text has been published and the period provided for in article 65.2 of the same regulation has elapsed. The document appears electronically signed by the Mayor, Rosario Andújar Torrejón, with a signature date of October 8, 2026.
Against the resolution, which exhausts the administrative route, interested parties may file:
- An optional appeal for reconsideration (recurso potestativo de reposición) before the same body that issued the act, within one month from the day following the receipt of the notification, according to articles 123 and 124 of Law 39/2015, of October 1.
- A contentious-administrative appeal before the Contentious-Administrative Section of the Court of First Instance, within two months from the day following the receipt of the notification, pursuant to article 46 of Law 29/1998, of July 13.
The final approval closes the municipal processing of an operation that expands the municipal land heritage by more than 15,000 m² of rural land and opens the door to the effective expropriation of the properties. For the owners in the surroundings of the Alcazaba, the agreement activates specific deadlines for judicial and administrative allegations; for the neighbors as a whole, it represents the first firm step toward a peri-urban archaeological park in one of the most relevant historical environments of the town.
