Olot suspends the processing of the ACR and the ARE of the Old Town

The Plenary of the Olot City Council has agreed to temporarily suspend the continuation of the processing for the final approval of the integrated declaration document of the Conservation and Rehabilitation Area (ACR) of the Old Town of Olot and the delimitation of the Building Rehabilitation Actions (ARE). The agreement, adopted in the session of July 23, 2026, resolves the ten allegations submitted during the public information period and is published in the Official Gazette of the Province of Girona no. 180, of September 18, 2026, with the official reference CVE BOP-2026_0_180_8140 (pp. 1-2).
The file originates from the initial approval agreement that the municipal Plenary approved on January 22, 2026. That document was submitted for public information via an announcement published in the Official Gazette of the Province of Girona no. 29, of February 12, 2026, as well as on the electronic notice board and the municipal website, and was individually notified to the property owners included within the scope of the action. During this period, a total of ten allegations were submitted.
Ten allegations and legal report
Having examined the allegations, the Plenary decided to resolve them in the sense stated in the response report issued on July 16, 2026, by the lawyer Daniel Jiménez Schlegl, which is incorporated into the file. The municipal agreement adopts the conclusions of this legal report.
The document bears the official identifiers reference no. X2025087498 and file no. UPL12025000012, and is electronically signed with the COVE code 6a0b43c8-b7e5-4aac-a631-eba9277d8c6e.
What is missing to resume processing
The response report highlights the need to complete the documentation relating to the Building Rehabilitation Actions delimited in the initially approved document, especially regarding:
- The specification of the technical interventions planned for the buildings included in the different action areas.
- The preparation of the preliminary technical studies necessary to determine the pathologies, deficiencies, and required rehabilitation actions.
- The incorporation of the economic evaluation of the actions, with cost estimates, planned public financing, and criteria for the distribution of burdens.
Once this technical, economic, and legal documentation is completed, the municipal technical and legal services must issue the corresponding reports on the sufficiency of the incorporated documentation, the maintenance, modification, or exclusion of the planned action areas, whether the introduced modifications are substantial or not, and the compatibility of the document with the current urban planning. These reports are required prior to the formulation of a new proposal to the Plenary regarding the resumption of the processing of the file.
Cooperation with owners and avenues of appeal
The Plenary also agrees to maintain and reinforce the model of cooperation and participation with the owners and legitimate occupants during the completion phase of the document.
The following appeals may be filed against the agreement:
- A contentious-administrative appeal before the Contentious-Administrative Chamber of the High Court of Justice of Catalonia, within a period of two months starting from the day following the publication of the announcement, in accordance with Article 46 of Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction.
- Optionally, a request for reversal (recurso de reposición) before the mayor’s office within a period of one month starting from the day following the publication, in accordance with Articles 123 and 124 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations.
The announcement is signed by the mayor Agustí Arbós Torrent, dated in Olot on September 2, 2026, with an electronic signature dated September 3, 2026.
The suspension leaves in the air, for the time being, the specific urban framework that was to govern the conservation and rehabilitation of the historic center of Olot, an area with a significant weight of aging buildings and pending works. For the affected owners and developers, the decision postpones legal certainty regarding which interventions will be required and how the economic burdens will be distributed, while the City Council must first finalize the technical studies and cost evaluation before bringing the file back to the Plenary.
