Por FactBox Admin

The Congress of the Republic promulgated Law 2639 of 2026, which creates the “Mi casa en Colombia” program so that Colombians residing abroad, affiliated with the National Savings Fund (FNA S. A.), can access mortgage loans and housing leasing to acquire housing in the country. The regulation is published in the Official Gazette number 53,664 of Tuesday, October 20, 2026, on page 1, and is effective as of the date of its publication.
The sanction corresponds to the President of Congress, Honorio Miguel Henríquez Pinedo, after the Presidency of the Republic returned the project on August 28, 2026, without the corresponding executive sanction, based on articles 166 and 168 of the Political Constitution and articles 199 and 201 of Law 5 of 1992. The processed text corresponds to Bill number 78 of 2024 Senate and 332 of 2025 House. It is also signed by the President of the Senate, Lidio Arturo García Turbay, and the acting President of the House of Representatives, Juan Sebastián Gómez Gonzales.
Program beneficiaries and products
The program is exclusively aimed at Colombians residing abroad who are affiliated with the National Savings Fund S. A. through the Contractual Voluntary Savings product, or the product that replaces it, and who meet the requirements established by the entity.
- Mortgage housing loan to acquire real estate in Colombia.
- Housing leasing for the same purpose.
- A permanent and specialized communication channel from the FNA for continuous attention and advice to compatriots abroad.
Priority and regulation within six months
The National Government, through the National Savings Fund and its Board of Directors, in coordination with the Ministry of Finance and Public Credit and the Ministry of Housing, City and Territory, must regulate the enablement, operation, functioning, and requirements of the program within a term not exceeding six months following its promulgation.
The regulation must incorporate priority for:
- Female heads of household whose minor children are domiciled in Colombia.
- Compatriots with relatives within the second degree of consanguinity with disabilities domiciled in Colombia.
- Persons with political asylum or refugee status, according to the applicant’s migratory status.
Regarding tax matters, current national and international regulations and the technical criteria of the National Directorate of Taxes and Customs (DIAN) will apply, especially concerning the exchange of information on foreign accounts. The draft regulation must be socialized and consulted with Congress before entering into force.
Dissemination, consular channels, and control
Dissemination will be the responsibility of the Fondo Nacional del Ahorro (National Savings Fund) and the Ministry of Housing, City and Territory, and will include Service Fairs for Colombians abroad, agreements with public and private entities, organizations and foundations supporting the migrant community, and the support of consular missions. At the national level, priority will be given to departments with a migratory vocation, and coordination will be carried out with the Referencing and Opportunities Centers for Return (Crore), in line with the Comprehensive Migration Policy and the Return Policy.
The FNA must submit semi-annual reports to the Seventh Commissions of Congress regarding the implementation of the program and a detailed balance of active affiliates and loans disbursed to Colombians abroad. The law authorizes the Government to incorporate the necessary budget items, subject to budget availability and the Medium-Term Fiscal Framework.
The regulation reaches a segment that until now depended on the general credit conditions of the FNA and which will be able to access housing in Colombia without residing in the country, with its own priority rules and a mandatory periodic report to Congress.
