Navacerrada aprueba la ordenanza de terrazas con multas de hasta 1.300 euros

The Navacerrada City Council has definitively approved the new regulatory ordinance for the private use or special exploitation of the local public domain through the installation of terraces, awnings, and other analogous elements. The agreement, adopted by the Plenary in the session of July 30, 2026, becomes definitive as no allegations were presented during the public exhibition period. The full text is published in the Official Gazette of the Community of Madrid (BOCM) no. 238, of October 6, 2026, with the official reference BOCM-20261006-49.

The regulation is approved under article 49 of Law 7/1985, of April 2, Regulating the Bases of the Local Regime, and article 17.3 of the revised text of the Law Regulating Local Treasuries, approved by Royal Legislative Decree 2/2004, of March 5. The ordinance expressly repeals the previous Police Ordinance for the occupation of public and private use lands with tables, chairs, and related items for profit purposes, and will enter into force once the period provided for in article 70.2 of the LRBRL has elapsed. An administrative appeal may be filed against the agreement within two months from the day following its publication.

Zoning and requirements on public roads

The text divides the municipality into three occupation zones:

  • Zone A: Plaza del Doctor Gereda and Paseo de los Españoles, in the section up to numbers 9 and 12, both included.
  • Zone B: Paseo de los Españoles from numbers 11 and 14, Avenida de Madrid, Plaza del Álamo, Prado Jerez, Plaza de los Ángeles, and calle Huertas.
  • Zone C: the remaining locations.

The occupation of the sidewalk must leave a clear passage of 1.50 meters if the sidewalk allows it and, in any case, a minimum width of 1.20 meters. Watering holes, hydrants, emergency exits, public transport stops, traffic registration and control devices, and transformation centers shall remain completely clear. Fixed or permanent elements that require construction, including tents and canopies, are prohibited, and furniture that hinders access to homes or permanent driveways may not be placed.

Hours, licenses, and deadlines

The operating hours for terraces will be until 24:00 hours on Mondays, Tuesdays, Wednesdays, Thursdays, and Sundays, and until 1:30 on Fridays, Saturdays, and eves of holidays. The collection and cleaning of the space may be delayed by up to 30 minutes, provided that no customers are seated or consuming during that time. Awnings may be installed throughout the entire calendar year.

Applications must be submitted before March 31, and the Mayor-President, or the body to whom they delegate, shall resolve them before May 31. Authorizations are understood to be granted for calendar years and are tacitly extended unless written notice to the contrary is provided before December 1. The license is personal in nature and is not transferred with the sale, lease, or transfer of the establishment.

Sanctions and infringement regime

Infringements are classified as minor, serious, and very serious, with the following economic regime:

  • Minor offenses: fines of up to 300 euros.
  • Serious offenses: fines between 300 and 600 euros.
  • Very serious offenses: fines exceeding 600 euros and up to 1,300 euros, with the possibility of the authorization being revoked.

Among the typified behaviors are the lack of ornamentation and cleanliness, the occupation of an area larger than authorized, the emission of noise above municipal limits, the installation of unauthorized furniture, and failure to comply with music schedules or the emission of noise starting from 12 midnight. The repetition of three minor offenses constitutes a serious offense, and three serious offenses constitute a very serious offense. Orders to remove elements must be complied with within a maximum period of 8 days, and upon the expiration of the authorization, the holder will have three days to clear the public ground.

Furniture, enclosures, and patron saint festivals

The furniture must be of the same model and design, with materials and colors consistent with the environment, and the space shall be delimited with approved rectangular planters. Awnings and umbrellas shall be made of plain textile material. The installation of pergolas or enclosures requires a prior municipal license and a competent technical certificate guaranteeing the mechanical stability and fire reaction of the materials. Outdoor heating is only permitted via portable “mushroom” type gas heaters, following notification to the Municipal Technical Services.

The installation of billiards, foosball tables, recreational or gambling machines, as well as the preparation of food in kitchens, griddles, barbecues, or stoves, is prohibited. Kiosks and alcoholic beverage bars for patron saint festivals or fairs shall have a maximum area of 16 square meters and will be awarded by public auction among the applications submitted before August 20 of each year.

The new ordinance replaces a previous, more lax framework with a detailed regime of licenses, schedules, and sanctions that directly affects the municipality’s hospitality operators and neighborhood coexistence. The text is signed by the mayor-president, Pablo Luis de Todos los Santos Jorge Herrero, in Navacerrada on September 25, 2026, and its publication in the official bulletin opens the period for eventual challenges.
