Nambroca revisa la adjudicación del sector 20 otorgada a Gadetur en 2008

The Nambroca City Council (Toledo) has initiated the administrative procedure to resolve the award of the Urbanization Action Program (PAU) for Sector 20 of the municipality’s Subsidiary Norms, which was granted in 2008 to Gata de Gorgos y Desarrollos Turísticos, S.L. (Gadetur, S.L.). The agreement was adopted by the municipal Plenary in a session on September 28, 2026, and is published via an announcement dated October 5, 2026, in the Official Gazette of Castilla-La Mancha number 200, dated October 19, 2026, with official reference 2026/7269.

The plenary agreement and the causes for resolution

The Plenary agreed to initiate the proceedings upon observing “the possible concurrence of legal causes for resolution,” according to the text of the announcement. The City Council specifies that the effective existence of these causes “shall be determined during the investigation of the file,” such that the opening of the procedure does not prejudge the outcome.

The award now being questioned stems from a plenary agreement dated June 9, 2008, more than eighteen years ago, by which the PAU of Sector 20 was placed in the hands of the company Gadetur, S.L. The Urbanization Action Program is the instrument that organizes the execution of a developable land area and grants the awardee the status of developer.

Call to owners and interested parties not located

During the processing, the City Council considers it mandatory to grant a hearing to those who may be affected by the eventual resolution of the Program. The announcement cites Article 114 of Decree 29/2011, which approves the Urbanization Action Regulations of the Recast Text of the Law on Land Planning and Urban Activity (RAE-TRLOTAU).

As it has not been possible to identify or locate all interested parties, and given the possibility that there are unknown holders, the Council resorts to a public announcement in accordance with Articles 44 and 45 of Law 39/2015, on the Common Administrative Procedure of Public Administrations. The call is addressed to:

  • The owners of the land included within the scope of action of Sector 20.
  • The holders of real rights over those same plots.
  • Any other interested parties who hold a legal position susceptible to being affected by the resolution.

Fifteen business day period and file consultation

Interested parties have a period of fifteen (15) business days, counted from the day following the publication of the announcement, to appear in the proceedings, examine the documentation, submit allegations, and provide the documents or means of proof they deem appropriate.

The file may be consulted at the offices of the Nambroca City Council, at Plaza de la Constitución number 1, during public office hours and following prior coordination with the competent municipal services. When electronic means permit, the documentation may also be accessed through the municipal electronic office. The announcement is signed by the mayor, Bernardette García Sánchez.

The text emphasizes that this is a procedural act within an ongoing proceeding, which does not decide the merits nor terminate the file; therefore, no independent appeal may be filed against it, without prejudice to the fact that the issues raised may be alleged for consideration in the final resolution.

Impact for the owners of the area

The decision directly affects the landowners of Sector 20, who have had an assigned developer for nearly two decades and now see the possibility of that assignment being revoked. For them, the announcement is the means to appear in a file that could redefine who executes the urbanization of the area and under what conditions, and the period of fifteen business days is the only window to assert their rights before the City Council resolves the matter.
