MTC declara en emergencia tramo de la ruta PE-36 A en Moquegua

The Ministry of Transport and Communications (MTC) declared a state of emergency for the public land transport service on the section of the conceded road between km 6+740.64 and km 6+899.16 of the national route of the National Road Network PE-36 A, sector No. 10: Dv. Moquegua–Torata, in the province of Mariscal Nieto, department of Moquegua. The decision is contained in Ministerial Resolution No. 584-2026-MTC/01.02, signed on October 19, 2026, by Minister José Angello Tangherlini Casal and published in the official newspaper El Peruano on Tuesday, October 20, 2026, in the Legal Norms section.

The regulation is based on Legislative Decree No. 1704, which authorizes the head of the sector to declare a state of emergency for the public transport service via ministerial resolution when a severe restriction or interruption of its continuity is verified, following a prior report from the entity competent in infrastructure management. It also invokes Law No. 29370, on the organization and functions of the ministry, Law No. 27181, General Law of Land Transport and Traffic, and the Regulations on Organization and Functions approved by Ministerial Resolution No. 658-2021-MTC/01.

The technical support gathers documents from the General Directorate of Transport Programs and Projects, the Directorate of Private Investment in Transport, the General Directorate of Transport Authorizations, the Road Safety Directorate, and the General Directorate of Multimodal Transport Policy and Regulation, including Report No. 0160-2026-MTC/18.04 and Report No. 1380-2026-MTC/18.01. The General Office of Planning and Budget, through Memorandum No. 2821-2026-MTC/09, reported that it has no observations regarding budgetary matters.

What the resolution provides

  • Article 1: declares a state of emergency for the land transport service in the identified section, which is detailed in the annex of the resolution itself.
  • Article 2: sets the validity for 180 calendar days, extendable, computed from the day following its publication in El Peruano.
  • Article 3: tasks the General Directorate of Transport Programs and Projects with adopting the necessary actions and interventions to preserve and overcome the service restrictions.
  • Article 4: obligates said directorate to inform the Vice-Ministerial Office of Transport, within a period of 10 calendar days, regarding the actions adopted and to be adopted.
  • Article 5: provides for the publication of the resolution and its annex on the MTC digital portal on the same day of its appearance in the official newspaper.

The annex georeferences the section in the UTM WGS84 system, zone 19 S: the start at 295,864.402 m E and 8,096,807.679 m N, and the end at 295,993.295 m E and 8,096,897.661 m N. It is, therefore, a segment of barely 158 linear meters within route PE-36 A.

Detected risks

According to the preamble, the section presents a high-risk situation due to the following conditions:

  • Geometric design that generates road conflicts, risk of accidents, and vehicle congestion.
  • Recurring circulation of heavy vehicles.
  • Deterioration and loss of pavement.
  • Deficiencies in horizontal and vertical road signage.
  • High number of vehicle-vehicle and pedestrian-vehicle contingencies.
  • Lack of safety at pedestrian crossings and difficult vehicle circulation.
  • Deficiencies in the lighting of the area.
  • Generation of particulate matter and dust, impacting environmental and transitability conditions.

Concession, works, and affected users

The section is part of the Concession Contract for the Construction, Conservation, and Operation of Section No. 5 of the South Interoceanic Road Corridor Project Peru–Brazil, signed between the Peruvian State and the company Concesionaria Vial del Sur S.A. – COVISUR. Subsequently, an inter-institutional cooperation agreement was signed with Anglo American Quellaveco S.A. for the execution, operation, and maintenance of the work “Improvement of Road Infrastructure Chen Chen Roundabout – Moquegua / Route PE-36 A km 6+900”.

The resolution specifies that this agreement does not transfer the ownership of the additional work nor the responsibility of the grantor, therefore the MTC remains responsible for the correct functioning of the infrastructure. 29 authorizations have been issued to companies in the section, allowing 97 vehicles to circulate transporting around 194,818 users who would be affected by the restrictions.

Impact for transporters and users

The declaration enables the MTC, its attached entities, and its special programs and projects to execute, directly or through contracting companies, the interventions necessary to restore the service; in conceded infrastructure, these actions are carried out in accordance with the concession contract. For the transporters operating in the corridor and for the nearly 195,000 users of the Dv. Moquegua–Torata sector, the measure opens the way for a priority intervention at a critical point of the national road network, although its actual scope will depend on the works executed within the 180-day period and any extension the sector may arrange.
