Minvu aprueba normas urbanísticas especiales para 286 viviendas sociales en Puente Alto

The Ministry of Housing and Urbanism (Minvu) approved special urban planning regulations for the land located at Avenida Eyzaguirre No. 2730, in the commune of Puente Alto, enabling the construction of 286 public interest housing units. The decision is contained in Resolution No. 16, signed in Santiago on August 17, 2026, by Minister Iván Poduje Capdeville, and was published in the Official Gazette No. 44,583 on Monday, October 26, 2026, Section I, pages 1 to 9 (official reference: CVE 2888575).

The exceptional mechanism of Law 21,450

The resolution is issued under article four of Law No. 21,450, regarding social integration in urban planning, land management, and the housing emergency plan, which established the exceptional mechanism of “Regulatory Enabling of Land.” Its validity was extended until December 31, 2029, by Law No. 21,798.

The instrument allows for the establishment of specific urban parameters for land registered in the name of a Serviu, in order to facilitate housing for beneficiaries of the Solidarity Housing Choice Fund (FSEV). The property, designated as Lot 1-E1, tax assessment role 2980-393, measures 28,688.23 m² and belongs to the Housing and Urbanization Service of the Metropolitan Region, with ownership registered at page 3,973 No. 6,347 of the year 2022 in the Real Estate Registrar of Puente Alto.

The land is partially located in Zone H4 “Residential and Equipment” and partially in Zone IM1 “Exclusive Productive Activity,” both of the Communal Regulatory Plan of Puente Alto, approved by mayoral decree No. 423 of 2003. This overlap restricted residential use and prompted the regulatory enabling.

The parameters that will govern the property

The approved special regulatory framework establishes:

  • Permitted land use: residential, housing destination.
  • Minimum plot area: 150 m².
  • Gross density: 400 inhabitants per hectare.
  • Maximum height: 12 meters, equivalent to 4 floors.
  • Grouping system: detached and semi-detached.
  • Constructability coefficient: 0.75; land occupation coefficient: 0.25.
  • Front yard: not required. Setback: according to the OGUC. Slant plane: 70°.
  • Parking: one per dwelling according to Law No. 21,442, with 15% for visitors according to the PRMS, and one bicycle for every two vehicle parking spaces.

The remaining urban regulations of the Communal Regulatory Plan of Puente Alto will continue to apply fully. The resolution specifies that these rules do not repeal or modify the communal instrument and may only be used for the FSEV project that justified the exceptional power.

A project of three lots and 286 units

The project contemplates a subdivision with simultaneous construction that will generate three residential lots, plus the cessions required by the General Law of Urbanism and Constructions. In two of them, Type A collective high-rise housing condominiums will be built, with 128 units each distributed across four four-story buildings. In the third, a Type A single-family housing condominium of three stories will be constructed, with 30 units.

The Municipal Council of Puente Alto, in its ordinary session No. 36 on December 19, 2025, unanimously approved the proposal through agreement No. 403-2025. The proposal was previously disseminated on the municipal website and submitted to a Strategic Environmental Assessment, initiated by exempt resolution No. 1,320 of August 2024 and closed by exempt resolution No. 24 of March 31, 2026.

The land faces the main artery Avenida Eyzaguirre, which is 20 meters between official lines, and is subject to public utility for widening by 37 m². It has feasibility certificate No. 00541 from Aguas Andinas, dated January 22, 2026, for 286 dwellings. In the southern sector, the Bozzo Morande Canal runs piped, and its easement strip of one meter per side is respected.

The scope of the Comptroller’s Office

The Comptroller General of the Republic processed the act through official letter No. OF197191/2026, dated October 16, 2026, signed by Comptroller Dorothy Pérez Gutiérrez, with two observations. The first specifies that in the regulatory table, it was appropriate to refer to “automobile” parking and not “vehicular” parking, according to ruling No. 418 of 2024. The second instructs that, henceforth, modifications that do not alter the environmental report must be communicated to the Ministry of the Environment, according to article 25 of decree No. 32 of 2015.

The surroundings of the property include educational and health facilities: the Politécnico Eyzaguirre, Sochides, Puente Maipo, and Monte Olivo schools, as well as the Cardenal Raúl Silva Henríquez and Karol Wojtyla Cesfam (Family Health Centers), and a wholesale supermarket at Avenida Eyzaguirre No. 1951.

The approval unlocks a plot of nearly three hectares in one of the communes with the highest real estate pressure in the Metropolitan Region and sets a precedent on how the Minvu can overcome restrictions of the communal regulatory plans to allocate them for social housing. The project must be materialized according to the General Scheme Plan and the technical proposal of August 2026 prepared by the Seremi of Housing and Urbanism of the Metropolitan Region, whose records will be archived in the Real Estate Registrar and in the Municipality of Puente Alto.
