Por FactBox Admin

MINCETUR abre consulta pública al nuevo Reglamento de Turismo de Aventura

The Ministry of Foreign Trade and Tourism (MINCETUR) has ordered the publication of the draft Supreme Decree approving the new Adventure Tourism Regulation and its Statement of Motives, with a period of twenty calendar days to receive comments, contributions, or opinions. The measure is contained in Ministerial Resolution No. 392-2026-MINCETUR, signed by Minister Rogers Valencia Espinoza and published in the official newspaper El Peruano on Tuesday, October 27, 2026. The draft has been available since that same day on the ministry’s digital portal.

The new framework would replace Supreme Decree No. 005-2016-MINCETUR, which approved the Safety Regulation for the Provision of Adventure Tourism Services and currently governs the operation of agencies authorized by the Regional Directorates of Foreign Trade and Tourism of the regional governments. The proposal is based on Law No. 32392, the New General Tourism Law, whose Article 32 and literal g) of Annex I recognize adventure tourism as a tourism service subject to the requirements established by the sector through supreme decree.

Twenty calendar days and three channels for comments

Article 1 of the resolution orders the publication of the draft and its statement of motives on the MINCETUR digital portal (www.gob.pe/mincetur) for a period of twenty calendar days, counting from the day following the publication of the resolution in El Peruano. With this calculation, the consultation period extends until November 16, 2026.

Article 2 enables three ways to submit contributions:

  • The ministry’s digital portal (www.gob.pe/mincetur).
  • The MINCETUR Filing Office (Mesa de Partes), located at Calle Uno Oeste No. 050, Córpac urbanization, San Isidro district, province and department of Lima.
  • The email address mromani@mincetur.gob.pe.

Comments should be addressed to the General Directorate of Tourism Development Policies of the Vice-Ministry of Tourism, the body responsible for receiving, evaluating, systematizing, and analyzing them. The call is open to public and private entities, civil society organizations, and interested natural persons.

From safety to the formalization of operators

According to the preamble, the Directorate of Tourism Norms and Quality of the General Directorate of Tourism Development Policies argues that it is necessary to approve a new regulation with five declared objectives:

  • Guarantee safety in the provision of adventure tourism services.
  • Incorporate technical provisions that reduce risks for tourists.
  • Strengthen the management of competent authorities.
  • Promote the formalization of operators.
  • Ensure that personnel have the necessary competencies and improve the quality of information provided to the tourist.

The document links these objectives to a “responsible and sustainable” development of the activity, within the framework of the ministry’s competencies to establish the sector’s regulatory framework and supervise its compliance.

The publication was authorized following a series of favorable internal reports, including Reports No. 0119-2026-MINCETUR/VMT/DGPDT/DNCT-MRN and No. 0067-2026-MINCETUR/VMT/DGPDT/DNCT-AVV, from the Directorate of Tourism Norms and Quality, and Memorandums No. 892 and 1208-2026-MINCETUR/VMT/DGPDT.

Added to these are:

  • Memorandums No. 855 and 1139-2026-MINCETUR/VMT, from the Vice-Ministry of Tourism.
  • Memorandum No. 834-2026-MINCETUR/SG/OGPPM and Reports No. 0084-2026-MINCETUR/SG/OGPPM/OM and No. 0013-2026-MINCETUR/SG/OGPPM/OPP, which issue a favorable opinion.
  • Report No. 0662-2026-MINCETUR/SG/OGAJ from the General Office of Legal Advice, which declares the publication via ministerial resolution to be legally viable.

The procedure is framed within paragraph 19.1 of article 19 and paragraph 21.1 of article 21 of the regulation for the publication and dissemination of norms approved by Supreme Decree No. 009-2024-JUS, as well as Supreme Decree No. 063-2021-PCM, which requires the Ex Ante Regulatory Impact Analysis. The resolution bears the visa of the Vice-Ministerial Office of Tourism, the General Secretariat, the General Directorate of Tourism Development Policies, the General Office of Planning, Budget and Modernization, and the General Office of Legal Advice.

Impact for agencies, guides, and regions

The regulation applies to agencies that market trekking, rafting, mountaineering, and other high-risk sports, as well as to regional governments that currently authorize and supervise these operators through their directorates of foreign trade and tourism. The consultation is the only formal opportunity for guilds, guides, mountain guides, and regional governments to influence the text before it is elevated to a supreme decree.
