Melilla repeals three unimplemented youth regulations and opens public exhibition
Por FactBox Admin

The Assembly of Melilla initially approved the Regulation by which the Ordinance regulating youth leisure and free time activities, the Ordinance by which the Census of Youth Associations and Entities Providing Services to Youth is created and regulated, and the Regulation of the Sectoral Youth Council are repealed. The agreement, adopted in an extraordinary resolution session on July 15, 2026, is published in the Official Gazette of the Autonomous City of Melilla (BOME) no. 6423, of October 16, 2026, with the reference BOME-A-2026-1171. The text is subject to one month of public exhibition before its final approval.
Context: streamlining of youth regulations
The initiative originates from the Department of Education, Youth, and Sports and has the favorable opinion of the Permanent Commission for Education, Youth, and Sports. The publication of the full text is carried out under article 84.2.c) of the Regulation of the Assembly of the Autonomous City of Melilla (Extraordinary BOME no. 10, of April 18, 2018).
The file is part of the Regulatory Plan of the Autonomous City of Melilla for 2026 and responds to the principles of good regulation under article 129 of Law 39/2015, of October 1. The document, signed by the Acting Secretary General of the Assembly, Diego Giner Gutiérrez, is dated October 14, 2026.
The three regulations being repealed
- Ordinance regulating youth leisure and free time activities of the Autonomous City of Melilla, published in BOME no. 4125, of September 28, 2004.
- Ordinance by which the Census of Youth Associations and Entities Providing Services to Youth is created and regulated of the City of Melilla, published in BOME no. 4125, of September 28, 2004.
- Regulation of the Sectoral Youth Council of the Autonomous City of Melilla, published in BOME no. 4297, of May 23, 2006.
The reasons: non-application, duplication, and inactive bodies
The preamble argues that the leisure and free time ordinance has not been applied in administrative practice since its approval: in more than 20 years of validity, there is no record of applications processed under it. Its model of prior authorization would have been superseded by state and regional sectoral regulations on health, safety, environment, and civil liability.
Regarding the census of associations, the text notes an unnecessary administrative duplication, as the registration and recognition of associations are carried out through the General State Administration (Government Delegation). Article 22.3 of the Spanish Constitution is invoked, which establishes registry enrollment as a declaratory rather than a constitutive instrument, and it is pointed out that the regulation imposes obligations, such as the annual submission of reports, that are not required in practice.
Regarding the Youth Sectoral Council, the Regulation concludes that it has had no effective or relevant activity in recent years, that its composition depends on the now-suppressed census, and that its non-binding reporting functions have been assumed by more agile mechanisms, such as public consultations and participatory processes.
One month for allegations and entry into force
- Public exhibition period: one month from publication in the BOME, during which citizens and legal entities may file claims.
- If no claims are filed, the text will be definitively approved; if there are any, the Plenary of the Assembly will resolve them and approve the regulation.
- Entry into force: the day following its publication in the BOME.
- Transitional provision: procedures initiated under the repealed regulations will continue to be processed in accordance with the regulations in force at the time of their initiation.
Impact
The repeal eliminates three provisions that had lacked effective application for two decades and suppresses a youth participation body without a functional structure, with the aim of simplifying the municipal legal framework regarding youth. For youth associations, the obligation to register in a regional census that conditioned access to subsidies disappears, although the text does not provide any substitute mechanism for sectoral participation.
