The title shall be valid for 20 years starting from its delivery and shall not be understood to be automatically extended. Upon expiration, permanently attached works shall revert to the Federation at no cost.
Background and considerations
The company already held the Concession Title ISO MR DGZF-921/06, granted on August 25, 2006, by the Ministry of Environment and Natural Resources over 2,192.58 square meters of the federal estuary zone. That title was extended through administrative resolution 376/2023, dated May 25, 2023, valid from September 21, 2021, to September 21, 2036. The work also has environmental impact authorization via official letter 138.01.00.01/2156/12, dated June 14, 2012, with a validity of 40 years.
For the use of the area, the concessionaire shall pay a utilization fee in accordance with Article 37 of the Ports Law, calculated using the Zone VIII key of Articles 232-C and 232-D of the Federal Law on Rights. Payment shall be monthly, no later than the 17th day of the month following the month in which it is incurred.
The concession opens a new docking point for private investment in Banderas Bay, one of the most dynamic nautical tourism corridors of the Mexican Pacific. For coastal users, the title establishes explicit obligations regarding free transit through federal land and water zones, environmental conservation, and operational safety.
