Por FactBox Admin

The Marchena City Council has declared the final approval of the Land Readjustment Project for Sector SUO-11 «Cañada Real de Sevilla», in the municipality of Marchena (Seville), by positive administrative silence. The approval occurred on June 19, 2026, according to the announcement published in the Official Gazette of the Province of Seville (BOP) number 211, Friday, October 30, 2026, in the Local Administration section, page 55, with official reference CVE: BOP-SE-2026-211014 and the signature of the acting mayor, Manuel Cristóbal Suárez Arispón.
The resolution arrives via the route of silence because, after four months had passed since the submission of the request for express ratification of the project, the City Council did not notify an express resolution. The silence is declared under Article 24 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations, in relation to Article 92.5 of Law 7/2021, of December 1, for the promotion of the sustainability of the territory of Andalusia (LISTA), and Article 157.3 of Decree 550/2022, of November 29, which approves the General Regulation of said law (RGLISTA).
From the Compensation Board agreement to municipal silence
The project that is now signed had been approved from within the private initiative itself: the Ordinary General Assembly of the Compensation Board of the single U.E. of Sector SUO-11 endorsed it in an ordinary session on June 24, 2025. From that point, municipal ratification was the pending step to finalize the planning of the execution unit.
The milestones of the file are as follows:
- Approval of the Land Readjustment Project by the Ordinary General Assembly of the Compensation Board of the sector’s single U.E., on June 24, 2025.
- Submission of the request for express ratification before the Marchena City Council, with no notified municipal resolution.
- Expiration of the legal period of four months without express notification of a resolution.
- Final approval by positive administrative silence, dated June 19, 2026.
- Publication of the announcement in BOP number 211, October 30, 2026, with an electronic signature dated October 27, 2026.
Document consultation and scope of the agreement
The full content of the definitively approved document is available to interested parties at the electronic office of the Marchena City Council, which can be accessed via the verification link included in the official announcement. Land readjustment is the instrument that organizes the new configuration of the parcels resulting from the execution unit and the corresponding allocation of land to the owners of the sector, along with the necessary complementary legal operations for its registration in the land registry.
The announcement emphasizes that the act exhausts all administrative remedies, meaning that only the appeals detailed below may be filed against it.
Deadlines for Appeal
Interested parties and affected owners have two options:
- Optional appeal for reversal (recurso de reposición) before the same body that issued the act, within one month from the day following the publication of the announcement, in accordance with Articles 123 and 124 of Law 39/2015.
- Contentious-administrative appeal before the Contentious-Administrative Court of Seville, within two months from the day following publication, pursuant to Article 46 of Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction.
Impact for Sector Owners
The publication closes a file that had been open for more than a year since the agreement of the Compensation Board and provides the owners of Sector SUO-11 «Cañada Real de Sevilla» with the effective timeline to defend their position: one month if they opt for reversal and two if they go to court. With the final approval, the land redistribution is formally closed and enables the continuation of the urban management of the sector through the compensation system, while consolidating the new ownership of the plots.
