Majadahonda delimita los ámbitos donde se podrá convertir terciario en vivienda protegida

The Plenary Session of the Majadahonda City Council approved in an ordinary session on September 24, 2026, the territorial areas in which the special regimes of Law 3/2024 for the change of use of private tertiary and facility lands to protected housing will be applied. The agreement is published in the BOCM no. 240, of October 8, 2026, section III (Local Administration), pages 266-268, with the reference BOCM-20261008-69, and is based on the Urban Planning report of 10/9/2026 (CSV: VY4KI-QSREQ-JCRKK).

Regulatory framework and scope

The decision develops the new wording of Law 3/2024 introduced by Law 2/2026, of June 11, on urgent measures to increase the Supply of Publicly Protected Housing. The agreement delimits where articles two, three, and four of the regional regulation operate and sets additional municipal conditions.

The text was signed in Majadahonda on September 29, 2026, by the delegated councilor for Urban Planning, Housing, Works and Infrastructure, Raúl Terrón Fernández, and is communicated to the General Directorate of Urban Planning.

Change of use: excluded areas

Article two, regarding the change of use to protected housing, will be applied with these exceptions:

  • Tertiary office use: does not apply in “Carril del Tejar” nor in “Carralero II”.
  • Tertiary lodging use: also not in “Carril del Tejar” nor in “Carralero II”.
  • Private facility use: does not apply in “Los Satélites”; it does apply in “Roza Martín”, with a limit of 70% of the buildability of each plot and two parking spaces per dwelling within the plot.
  • Does not apply in sectors of unconsolidated urban land (SUNC) or sectorized developable land (SUZS) that, upon the entry into force of Law 2/2026, did not have their urban planning instruments definitively approved.
  • Does not apply where tertiary offices, lodging, or private facilities are not the primary use of the area or sector.

Buildability, density, and temporary accommodation

Article three, regarding the increase of buildability and density in protected housing plots, will not be applied in “Los Satélites” nor in “Roza Martín”. It will operate in other consolidated urban land areas with unbuilt plots classified as protected housing, and in SUNC such as “La Leontina” or in the four sectors of Arco de Poniente (SUZS).

Article four, regarding the enabling of temporary accommodation in industrial use plots, will not be applied in any point of the municipal district. The regimes of articles two and three will govern the rest of the urban land.

Developer obligations

Among the municipal conditions, the following stand out:

  • Only vacant building plots as of the date of entry into force of Law 2/2026 may apply.
  • Associated or complementary uses may not exceed 20% of the buildability allocated for housing.
  • Sectoral corrective measures, such as acoustic protection, and the expansion of external public infrastructure and networks shall be the responsibility of the developer.
  • The actions must include the pneumatic waste collection network required in the municipality.
  • An economic sustainability report (Article 22.4 of the TRLS 2015) and an economic viability memorandum will be required.
  • The transfer of the community’s share in capital gains is set at 5% of the weighted average increase in buildability, payable upon granting the building permit.

Publication and Procedure

The agreement will be published in the BOCM, the Transparency Portal, the notice board, and the municipal website, and will be sent to the General Directorate of Urban Planning along with the report from the Urban Planning Service that serves as its justification.

The delimitation specifies which areas are excluded from the change of use and which burdens the developer assumes, thus setting the expectations of developers and residents regarding where new protected housing may be materialized in Majadahonda and under which economic and urban planning conditions.
