Por FactBox Admin

The Madrid City Council has published in the Official Gazette of the Community of Madrid (BOCM) the urban planning regulations applicable to the Specific Modification of the 1997 General Urban Development Plan of Madrid for the plot located at Pintor Moreno Carbonero Street, number 17, in the Salamanca district. The announcement, processed by the Government Area of Urbanism, Environment and Mobility under file 135-2024-00330, appears in section III (Local Administration) of BOCM number 232, dated September 29, 2026, starting on page 143, with the official reference BOCM-20260929-32. The final approval corresponds to the Governing Council of the Community of Madrid, which adopted the agreement on September 2, 2026.
The regional agreement and its publication
The agreement of the Governing Council was previously published in BOCM number 215, dated September 9, 2026, in accordance with article 66.1.a) of Law 9/2001, of July 17, on Land of the Community of Madrid. It is now the responsibility of the Madrid City Council to comply with article 66.1.b) of that same law, in relation to article 70.2 of Law 7/1985, of April 2, on the Bases of the Local Regime, by publishing the full content of the part of the planning required by local regime legislation.
The agreement was signed by the Councilor for Environment, Agriculture and Interior, Carlos Novillo Piris, and by the President of the Community of Madrid, Isabel Díaz Ayuso. An administrative appeal may be filed against it before the High Court of Justice of Madrid within two months from the day following its publication.
What changes in the catalog and the land
The modification has a dual purpose, according to the file:
- The correction of a material error detected in sheet CB 60/8 of the Catalog of Singular Elements, relating to the area of the protected garden with level 1 and catalog number 51104, delimited by the streets of José María Sánchez Silva, Parral, Francisco Remiro, Pintor Moreno Carbonero and the endowment plot of Méjico Street, number 53.
- The inclusion in the Catalog of Singular Trees of the Phoenix canariensis specimen on the estate, to which catalog number 60849 is assigned.
The main building is cataloged with level 2, partial grade, catalog number 29132 (sheet CA 60/8 of the Buildings Catalog). The area is completed with the plots and public spaces of the Specific Planning Area APE.04.04 “El Parral”: Pintor Moreno Carbonero 21, Avenida Camilo José Cela 29, Francisco Remiro 11, 17 and 21, Canalillo 2, the Vía del Parral and the newly designed public roads and extensions of Pintor Moreno Carbonero and Ruiz de Ocaña.
Origin, procedures and environmental report
The process began with the application from the entity Hijas de la Caridad de San Vicente de Paúl for a Special Plan regarding the plot. The Commission for the Protection of Historical, Artistic, and Natural Heritage issued a favorable report on the removal from the heritage catalog, considering the existing protection to be excessive. The Plenary of the Madrid City Council initially approved the document on October 16, 2025, and provisionally on May 26, 2026.
The administrative milestones were as follows:
- April 29, 2026: Favorable Strategic Environmental Report from the General Directorate for Energy Transition and Circular Economy.
- July 6, 2026: Technical report from the General Directorate of Urban Planning.
- July 9, 2026: Favorable legal report for final approval.
- July 23, 2026: Favorable report from the Urban Planning Commission of Madrid.
The annex incorporates environmental considerations as execution rules, with special attention to Law 8/2005, of December 26, on the protection and promotion of urban trees, and the prohibition of felling and drastic pruning. The municipal announcement was signed in Madrid on September 17, 2026, by the Director General of Planning, María Ángeles Fernández Hernando, and by the acting Secretary General of the Plenary, Juan José Orquín Serrano.
Impact for affected parties
The publication closes the administrative route of the file and establishes the land rules that will govern the plot and its surroundings in the Salamanca district, with direct effects on owners, developers, and residents of the El Parral area. The file is deposited for consultation at the Urban Planning Information Unit of the Ministry of Environment, Agriculture, and Interior, at Alcalá Street, number 16, fifth floor, Madrid.
