Madrid sets the hiring conditions for vocational training (FP) experts in educational centers
Por FactBox Admin

The Governing Council of the Community of Madrid has approved Decree 93/2026, of October 30, which establishes the hiring terms for experts from the productive sector and senior company experts in educational centers that provide non-university vocational training. The regulation is published in the BOCM number 264, of November 3, 2026, in section I.A (General Provisions), page 13, with the official reference BOCM-20261103-1, and enters into force on November 4, one day after its publication.
The framework: from the LOE to the new VP law
The decree implements in the region Article 95.2 of the Organic Law 2/2006, of May 3, on Education, which allows for the incorporation of professionals who are not necessarily degree-holders as experts from the productive sector, and Articles 88 and 89 of the Organic Law 3/2022, of March 31, on the organization and integration of vocational training, which create the figures of the productive sector expert and the senior company expert. The state regulatory development is Royal Decree 659/2023, of July 18, whose Articles 170 and 171 require educational administrations to determine the conditions for authorization and hiring.
The processing included reports on coordination and regulatory quality, social impacts, and from the Technical General Secretariat of the Ministry of Education, Science and Universities, in addition to the opinion of the School Council, the report from the Attorney General’s Office, and the public hearing and information procedures. The text bears the signature of the Minister Mercedes Zarzalejo Carbajo and the President Isabel Díaz Ayuso.
Requirements, 25% quota, and selection
The regulation applies to all non-university centers—public, private, and semi-private (concertados)—that provide Grade D VP (basic, intermediate, and higher levels) and Grade E (specialization courses). Applicants must:
- Accredit at least three years of professional activity, outside of teaching, within the ten years prior to hiring, in the field of the specialty or module to be taught.
- In the case of senior experts, also be on a partial reduction of working hours prior to retirement, or on partial or flexible retirement.
- Present a negative certificate from the Central Registry of Sexual Offenders and Human Trafficking, in accordance with Organic Law 8/2021.
- Request activity compatibility if they are currently employed, according to Law 53/1984, on incompatibilities of personnel in the service of Public Administrations.
Hiring only proceeds if ordinary channels are exhausted—in public centers, when a position called three times remains vacant—or if it is necessary to guarantee mastery of specific processes of the productive sector. The annual sum of working days for these experts may not exceed 25% of the working days of the FP teaching staff of Grade D and E of the center. In public centers, selection will be by a merit competition, using the scale in the annex: up to 7 points for professional experience and another 7 for training.
Remuneration, functions, and participation in the center
Experts in public centers will receive monthly remuneration equivalent to that of interim civil servants of the teaching body of the corresponding specialty, with the exception of the permanent training supplement for teachers; for part-time positions, these will be proportional. In subsidized and private centers, the collective agreement will apply.
They will carry out their functions under the supervision of the head of department or the director, and the signing of evaluation documents will be endorsed by the department head or the management. They will be part of the faculty and the departments, but they may not be electors or eligible for single-person governing bodies.
The decree repeals Decree 154/2001, of September 20, regarding vocational training and maintains the contracts of FP specialist teachers in effect until the hiring of candidates selected through the new procedure.
Impact
The regulation opens a regulated path for company professionals, including senior profiles nearing retirement, to teach in training cycles, with a ceiling of 25% of the teaching load per center. For educational centers, it implies a new selection and justification procedure before the Educational Inspection; for companies and applicants, a public merit scale and fixed remuneration.
