Madrid aprueba definitivamente el Plan Especial de vivienda protegida

The Madrid City Council has definitively approved the Special Plan for the Application in the Municipality of Madrid of Law 3/2024, of June 28, on Urban Planning Measures for the Promotion of Protected Housing. The agreement was adopted by the Most Excellent Plenary Council in an extraordinary and urgent session held on October 8, 2026, under file 135-2026-00100. The resolution is published in the OFFICIAL GAZETTE OF THE COMMUNITY OF MADRID number 245, of October 14, 2026, section III (Local Administration), pages 264 to 267, with the official reference BOCM-20261014-60.

The text is approved through the Government Area of Urbanism, Environment, and Mobility and develops the additional conditions for applying the special regimes of articles two, three, and four of Law 3/2024, as amended by Law 2/2026, of June 11, on urgent measures to increase the supply of housing with public protection. The approval complies with article 59.2 of Law 9/2001, of July 17, on the Land of the Community of Madrid, in relation to its articles 57 and 62.2, and the agreement concludes the administrative process.

A public initiative plan with four regulatory blocks

The published document includes the regulatory content of the Plan, structured into four sections:

  • First Section. General issues: establishes the scope of the regulation and specifies that the determinations of Law 3/2024 apply directly, respecting the Urban Planning Rules of the 1997 General Urban Development Plan (PG97).
  • Second Section. Alternative residential use: regulates the implementation of protected rental housing on plots with qualified use as tertiary offices, tertiary lodging, or private facilities.
  • Third Section. Increase in buildability and density: conditions for plots intended for the construction of housing with public protection.
  • Fourth Section. Temporary accommodation: enabling of this figure on plots with industrial qualification.

What is permitted and what is excluded

The alternative residential use is implemented in the collective housing category and occupies the entire plot, without other uses other than the permitted complementary ones. The following plots are excluded:

  • Those whose qualified use is industrial in coexistence with tertiary offices.
  • Those included in grades 3rd, 4th, or 5th of zonal rule 9 or in areas and sectors with global industrial use or industrial use in coexistence with tertiary offices.

In private community service plots, implementation requires qualified community service use for collective services in the sports and equipment categories, with a private implementation level, and complementary uses are not permitted. The increase in buildability shall not be applicable to plots intended for single-family housing. Temporary accommodation is assimilated into the lodging category of tertiary use and is governed by the compatibility rules of the PG97.

Allegations, deposit, and appeal period

The Plenary upheld, partially upheld, and dismissed the allegations submitted during the public information period, according to the allegations analysis report of September 26, 2026, and the proposal report of October 2, 2026, from the General Directorate of Planning. Both documents will be available to the claimants and the public on the municipal transparency page.

The agreement was sent to the Administrative Registry of the Department competent in urban planning matters and is published in compliance with Article 66 of Law 9/2001. A contentious-administrative appeal may be filed against it before the corresponding Chamber of the High Court of Justice of Madrid within two months, counting from the day following publication, pursuant to Article 46 of Law 29/1998, of July 13.

The announcement was signed in Madrid on October 9, 2026, by the Director General of Planning, P. S. (Decree of September 29, 2026), Beatriz Provencio García, and by the acting Secretary General of the Plenary, the Deputy Secretary General of the Plenary, Juan José Orquín Serrano.

The Special Plan establishes the framework through which developers and owners of tertiary, private community service, or industrial land in the capital may convert their plots into protected rental housing, increase buildability, or enable temporary accommodation. Its entry into force determines which lands are suitable and which are excluded, a decisive factor for the viability of developments and for the urban execution calendar in Madrid.
