Environmental green light for the Territorial Urban Planning Regulations of Palencia
Por FactBox Admin

The Regional Ministry of Agriculture, Livestock, Rural Environment, and Environmental Policy has formulated the strategic environmental statement for the Territorial Urban Planning Regulations of the province of Palencia, the procedure that unlocks the new provincial-level land management framework. The decision is recorded in Order AGR/1139/2026, of October 26, published in the Official Gazette of Castilla y León no. 212, of November 3, 2026, with official reference BOCYL-D-03112026-212-14 and file EAEO/2022/025.
The text, signed in Valladolid on October 26 by the regional minister Joaquín Antonio Pino, provides a favorable report on the development of the instrument “for environmental purposes only,” provided that the conditions detailed in the annex are met. The authority to issue it corresponds to that ministry following Decree 2/2026, of June 13, on the restructuring of regional ministries, and the resolution is adopted at the initiative of the Directorate General of Environmental Policy, while the plan is promoted by the Directorate General of Housing, Architecture, Territorial Planning, and Urbanism.
The NUT (Territorial Urban Planning Regulations) are supra-municipal planning instruments that establish the general and detailed management determinations necessary in municipalities that do not have a General Urban Management Plan or Municipal Urban Planning Regulations, and they remain applicable as long as that circumstance persists. They have the nature of a general planning instrument according to article 76 d) of the Urban Planning Regulations of Castilla y León, approved by Decree 22/2004, of January 29, and among their objectives are contributing to population stabilization and adapting the municipal urban framework to the Urban Planning Law 5/1999 of Castilla y León.
A scope of 118 municipalities without their own planning
The province of Palencia is divided into 191 municipalities, but the scope of application is limited to the 118 that have a delimitation of urban land or lack any type of planning. Municipal land is classified into only two categories, rural land and urban land, as the NUT do not classify any sector of developable land.
Rural land is divided into seven categories:
- Common (SR-C), over agricultural crops, mostly rain-fed.
- Traditional Settlement (SR-AT), which protects traditional forms of occupation, including wine caves and the abandoned villages of San Martín de la Fuente and Villatima, in Moratinos.
- Agricultural Protection (SR-PA), over irrigated lands in the valleys of the Pisuerga and the Carrión according to ITACyL data.
- Infrastructure Protection (SR-PI), with strips along roads, railways, high-voltage lines, gas pipelines, and oil pipelines.
- Natural Protection (SR-PN), with grades for SPAs, SACs, livestock routes, forest masses, riverbeds and banks, slopes and hillsides, geological interest, and ecological corridors.
- Cultural Protection (SR-PC), for archaeological sites, cultural axes of the Canal de Castilla and the Way of St. James, and the masonry corrals of Cerrato.
- Special Protection (SR-PE), in the preferential flow zones defined by the basin authority.
Heritage, Natura Network, and risks under condition
The technical analysis confirms the presence of ten Natura 2000 Network sites, including the SACs “Montes del Cerrato” (ES4140053), “Riberas del Río Pisuerga y afluentes” (ES4140082) and the SPAs “La Nava – Campos Norte” (ES4140036) and “Camino de Santiago” (ES0000201), with no apparent damage to their integrity. 27 habitats of community interest have been inventoried, seven of them priority, and 18 wetlands of special interest.
Among the imposed determinations, the following stand out:
- Incorporate the Palencia Museum, the Historical Archive of Palencia, and the State Public Library in Palencia into the protection catalog, at the request of the General Directorate of Cultural Heritage and Fine Arts.
- Include the wetland ZHC-PA-25 “La Charca de los Corrales” and update the delimitations of wetlands and their peripheral areas.
- Notify ADIF of the property structure before approving execution instruments that affect its inventory of real estate.
- Approve a Municipal Discharge Ordinance in municipalities that lack one.
- Do not increase the risk to people, property, and the environment in the planned actions.
Allegations and deadlines that open the calendar
The processing began on October 18, 2022, with the initial request, and the scoping document was approved on July 6, 2023. The public information period was announced in the Official Gazette of Castilla y León no. 150, dated August 6, 2025, and during that period, 32 private allegations and 24 from city councils were received. The file entered the Environmental Evaluation Service on August 15, 2026, and approximately thirty administrations were consulted, including the Duero Hydrographic Confederation, the Civil Protection and Emergencies Agency, and the Provincial Council of Palencia; the Territorial Service of Industry, Trade and Economy of Palencia issued an unfavorable report regarding article 6.3.3 on extractive activities.
The declaration will lose its validity if the plan is not approved within two years of its publication, and the substantive body must send the documentation to the gazette within 15 days following the approval.
The environmental ruling was the requirement holding up the final stretch of an instrument called upon to replace the absence of planning in the majority of Palencia’s municipalities. For the affected city councils, it means having clear land classification rules for the first time; for developers and owners, a stable framework on what can be done on rural land, with protection categories that limit uses in areas of higher agricultural, natural, and heritage value.
