LIPASAM sets workshop officers exam for two months from now

The negotiating commission of the XIII Collective Agreement of LIPASAM unanimously agreed to extend the probationary period to two months for the categories of 1st Workshop Official and 3rd Workshop Official. The agreement modifies Article 12 of the agreement and is published in the Official Gazette of the Province of Seville number 185, corresponding to Wednesday, September 23, 2026, with the official reference BOP-SE-2026-185024. The measure affects new hires of the municipal company.

The minutes of the negotiating commission, dated in Seville on March 2, 2026, state that the meeting had a single item on the agenda: the proposal to modify Article 12 of the XIII Collective Agreement of LIPASAM regarding the probationary period for 1st Workshop Official and 3rd Workshop Official. Twelve worker representatives and three from the business representation participated in the session:

  • For the worker representation: Antonio Bazo Mora, José Antonio del Castillo Peña, Andrea Rodríguez Domínguez, Manuel Gómez Ruiz, Guillermo Galvez Romero, Mª. Carmen Elías Morillo, Isabel María Gómez Muñoz, Antonio Jesús Molina Doñoro, Rafael Moreno Méndez, Mª. del Carmen Martínez Guardiola, Daniel García Jiménez and Jacinto García Rodríguez.
  • For the business representation: Alejandro Andujar Bors, Carolina Fernández Escorial and Ana Cabrero Moreno.

The business representation opened the debate by explaining the need to adapt the regulation of the probationary period for 3rd Workshop Official. It argued that, given the high specialization and technical complexity of the LIPASAM vehicle fleet, a one-month period is insufficient to evaluate the skill, expertise, and adaptation of new hires, and that a rigorous evaluation is fundamental to guarantee safety, correct operability, and vehicle maintenance. Therefore, it proposed extending the period to three months.

The social side demands extension to 1st Official as well

The worker representation expressed doubts about the possibility of modifying the probationary period beyond what is reflected in the Workers’ Statute. Furthermore, it maintained that if the probationary period for 3rd Workshop Official were modified, it should be equally extended for 1st Workshop Official.

After the interventions of both parties, the worker representation requested a recess. Upon returning, and after a debate, both parties unanimously agreed to modify Article 12 of the XIII Collective Agreement of LIPASAM, which finally sets the probation for both categories at two months—and not the proposed three.

The new wording of Article 12

The approved text establishes the following probationary periods:

  • Service Director and Service Heads, Person in Charge, Technical Head, and Process Management Technician: 6 months.
  • Administrative Officer, Inspector, Foreman, Workshop Master, Workshop Team Leader and Workshop Officer, Transfer Plant Operator, Pneumatic Plant Operator, 1st Workshop Officer, and 3rd Workshop Officer: 2 months, provided that the formalized contracts exceed 6 months in duration.
  • Other professional categories: 1 month.

During the probationary period, either party may terminate the employment relationship by notifying the other in writing. It shall be understood that the probationary period has been passed if the company does not dispense with the employee within that timeframe.

Interruptions of the count and internal promotion

The article also regulates two scenarios. In the event of an internal promotion to a higher category, if the probationary period for the latter is not passed, the worker will return to the original professional category they held prior to the promotion process.

Furthermore, situations of temporary disability, risk during pregnancy, maternity, adoption or fostering, risk during breastfeeding, and paternity that affect the worker during the probationary period interrupt the count of said period, which is completed at the time of discharge from that situation.

Validity and publication procedures

The agreement enters into force on the date of its signing and authorizes Ana Cabrero Moreno to carry out the necessary registration, deposit, and publication procedures before the competent labor authority. The minutes record the date of March 2, 2026, in the header and March 2, 2025, in the signature block.

The modification increases the evaluation margin for new hires in two workshop categories of the municipal company from one to two months, with the stated objective of guaranteeing the safety and maintenance of a vehicle fleet of high technical complexity. The agreement is also adopted with the unanimous support of both representations, which clears the only point that the negotiating commission of the XIII Collective Agreement of LIPASAM had on the table.
