Decree No. 2026-956 of October 14, 2026, regarding the opening and cancellation of credits by way of advance, published in the Official Journal of the French Republic No. 0241 of October 15, 2026, opens €405,514,403 in commitment authorizations (AE) and €415,514,403 in payment appropriations (CP) from the general state budget. The text, referenced NOR CPPB2626847D, is supported by report NOR CPPB2626847P, which details its purpose: to finance urgent expenditure to support the agricultural sector and the response to the energy crisis. The Minister for Action and Public Accounts is responsible for the execution of the decree, which enters into force immediately.
An agricultural plan launched without waiting for the finance law
The report justifies the urgency: the credits available in the relevant programs, even after the mobilization of reserved credits and redeployments, did not cover the needs, and their opening could not wait for the next finance law. Furthermore, the Government announces additional openings in the draft finance law for the end of the 2026 management period.
For farmers, nearly €426 million are mobilized as of October, thanks to the release of €201 million in reserved credits and the opening of €225 million via an advance decree. The Climate, Adaptation, Drought, Fires (CASI) plan is based on four measures:
- accelerated compensation for losses under national solidarity, paid by the National Fund for Agricultural Risk Management (FNGRA);
- the deployment of an agricultural rearmament fund, the territorial component of the plan, managed by the prefects;
- the coverage of agricultural social security contributions by the Agricultural Social Mutual (MSA);
- the extension of exceptional support for agricultural non-road diesel (GNR).
High-mileage drivers and fishers: €191 million for the energy crisis
The energy component mobilizes €150 million in AE and CP under program 174 “Energy, Climate and Post-Mining” for the “high-mileage drivers” indemnity:
- extension of funding for accepted files from deciles 1 to 5, with an increase to €200 per beneficiary;
- creation of a new indemnity for deciles 6 to 7;
- common criteria: professional use of the vehicle or home-to-work commutes, with an annual professional distance greater than or equal to 8,000 km, or a home-to-work distance greater than or equal to 15 km.
Under program 205 “Maritime Affairs, Fisheries and Aquaculture,” €41M funds the “Fuel Aid” window for fishing companies, operated by the Payment Services Agency (ASP). The flat-rate aid is set at 25 cents per liter for June, July, and August; from September to December, the State compensates 70% of the increase in gas oil prices. The ASP must pay the aid within four weeks after the submission of a complete file.
Funding offset by the public energy service
The appropriations are fully offset by a cancellation of €405,514,403 in payment appropriations (AE) and €415,514,403 in commitment appropriations (CP) under program 345 “Public Energy Service,” primarily from the precautionary reserve. The report explains this by the updating of energy prices and the decrease in public service charges: as rising electricity prices make renewable energy production more profitable, State support for producers is adjusted downwards compared to the initial finance law for 2026, without impacting the execution of public policy.
The decree was issued following the opinion of the finance committees, in accordance with Article 13 of the organic law relating to finance laws: the project, communicated by the Government on October 5, 2026, was examined by the finance committee of the National Assembly (general rapporteur Philippe Juvin) and that of the Senate (general rapporteur Christine Lavarde).
What the decree changes for beneficiaries
Fragile farmers, fishers, and high-mileage workers benefit from an accelerated schedule: FNGRA compensation and the territorialized re-equipment fund are endowed without waiting for the finance law, “high-mileage” files for deciles 1 to 5 increase to €200 and are extended to deciles 6 and 7, and fuel aid for fishers is funded until December. Since the funding is offset by renewable energy credits deemed surplus, the operation is presented as neutral for public finances, but it shifts €406M in credits from one program to three others, pending additional appropriations at the end of the 2026 management period.
