The Mancomunidad de las Tres Torres submits its cost structure for public review
Por FactBox Admin

The Governing Board of the «Las Tres Torres» Water Association initially approved on October 23, 2026, the proposed cost structure for the contracting of the concession for drinking water supply, sanitation, and purification services, which covers the municipalities of Torreorgaz, Torremocha, and Torrequemada (Cáceres). The agreement, adopted under file 11/2026, is published as a public information announcement in the Official Gazette of the Province of Cáceres number 0208, dated October 29, 2026, with reference CVE: BOP-2026-5069. Citizens and interested operators have 20 business days to submit allegations.
Six revisable components versus three fixed
The document distributes the total value of the activity across nine cost components and specifies which ones may be subject to price revision. The proposal identifies six revisable items that total 81.0% of the total cost:
- Personnel: 42.0%, revisable
- Maintenance and conservation: 11.0%, revisable
- Reagents, analytical control, and waste: 9.5%, revisable
- Electrical energy: 9.1%, revisable
- Administration, commercial management, and insurance: 5.9%, revisable
- Vehicles: 3.5%, revisable
The remaining three items are excluded from any revision regime and represent 19.0% of the total value: general and structural expenses (8.2%), charges linked to income (5.6%), and industrial profit (5.2%). The indices associated with each component and their justification are detailed in the documentation submitted for the process.
The legal framework of de-indexation
The announcement is based on Article 9.8 of Royal Decree 55/2017, of February 3, which develops Law 2/2015, of March 30, on the de-indexation of the Spanish economy, as well as Article 83 of Law 39/2015, of October 1. Pursuant to Article 3 of the aforementioned royal decree, only cost variations that are not subject to the control of the economic operator may be included in the revision regimes.
Article 7 further establishes the applicable conditions:
- Variations in financial costs, depreciation, general or structural expenses, or industrial profit are not included.
- Only costs indispensable for carrying out the activity and that are significant—meaning they represent at least 1% of the total value—are permitted.
- Labor costs may be included, within the limits of the royal decree, provided they are significant.
The proposal was developed after consulting five economic operators in the sector, as stated in the first point of the agreement.
Allegations, consultation, and subsequent procedure
The public exhibition period is 20 business days starting from the day following the publication of the announcement in the BOP of Cáceres. Any natural or legal person may submit allegations addressed to the Governing Board through the electronic registry or by the means admitted in article 16.4 of Law 39/2015. The documentation can be consulted at the headquarters of the association, at calle Moral, n.º 1, 10182 Torreorgaz (Cáceres), from 09:00 to 14:00 hours, and at the electronic headquarters http://mclastrestorres.sedelectronica.es/.
The allegations will be examined and assessed with justification by the contracting body before establishing the definitive structure. The agreement also provides for communicating the resulting structure, for informational purposes, to the Higher Committee for State Contract Prices and, where appropriate, to the corresponding regional advisory body, and incorporating the proposal and the justifying report of the revision formula into the file to establish said formula and justify the duration of the contract. The announcement is signed by the president, Francisco Giraldo Pavón, in Torreorgaz, on October 23, 2026.
Why it matters
The cost structure determines how much the water tariff can increase in three municipalities throughout the life of the contract: by leaving 81% of the cost exposed to revision, the bulk of the price remains linked to external indices such as wages, energy, or maintenance, while the industrial profit and structural expenses remain frozen. This procedure now opens the only formal window for city councils, residents, and companies in the sector to discuss this distribution before it is incorporated into the specifications.
