The Territorial Delegation of Housing, Youth, Territorial Planning, Public Works and Mobility in Seville has agreed to initiate the compulsory expropriation procedure via urgent process for the lands and rights affected by the complete electrification of the tram line to Alcalá de Guadaíra. The announcement is published in the Official Gazette of the Province of Seville no. 214, Thursday, November 5, 2026, with the official reference BOP-SE-2026-214034, and sets the drawing up of prior occupation records for December 15, 2026, at the Alcalá de Guadaíra City Council.
The origin of the file is the Resolution of February 14, 2023, from the General Directorate of Transport Infrastructure, then dependent on the Ministry of Public Works, Territorial Articulation and Housing, which ordered the start of the expropriation to obtain full possession of the assets affected by the “Construction project relating to the electrification of the entire tram line to Alcalá de Guadaíra between the Pablo Olavide University and Montecarmelo.” The agreement is signed by the territorial delegate, María Teresa Ávila Guisado, with an electronic signature date of October 30, 2026, and a registration stamp of November 3.
The legal framework invoked is Article 52 and following of the Compulsory Expropriation Law of December 16, 1954, Article 56 of its Regulation of April 26, 1957, and Article 10.2 of Law 9/2006, of December 26, on Railway Services of Andalusia. The approval of the project inherently implies the declaration of public utility and the need for land occupation.
Two properties and appearance at the City Council
The annex to the agreement identifies the holders of assets and rights affected by the execution of the work. The list is brief and concentrates all impact on a single company, MERSEMAR SL, owner of two plots in the municipality of Alcalá de Guadaíra:
- Cadastral reference 4586901TG4448N0001MS, with 22,233 m² of cadastral area and appearance scheduled for 12:30 p.m.
- Cadastral reference 4690886TG4348N0001DU, with 26,605 m² of cadastral area and appearance scheduled for 12:00 p.m.
- Registered impact of 1,409 m² of temporary occupation.
The act will be held on December 15, 2026, between 12:00 p.m. and 12:30 p.m., at the Most Excellent City Council of Alcalá de Guadaíra, following the corresponding personal notifications.
15 business day period for allegations
The agreement opens a public information process of 15 business days from its publication in the Official Gazette of the Regional Government of Andalusia and in the Official Gazette of the Province of Seville. During this period, the owners and any interested party may submit written allegations to the Territorial Delegation and consult the Expropriations annex on the City Council’s notice board and at the Delegation’s headquarters in Seville.
The list of interested parties will also be published on the notice board of the Territorial Delegation, that of the City Council of Alcalá de Guadaíra, in the Official State Gazette, in the BOJA, in the BOP of Seville, and in the Diario de Sevilla. These announcements serve as notification to unidentified interested parties, those with unknown ownership, or those whose whereabouts are unknown, in accordance with article 52.2 of the Compulsory Expropriation Law and articles 44 and following of Law 39/2015.
Documentation required from owners
Those summoned must attend personally or be represented by an authorized person, and may be accompanied at their own expense by experts and a notary. They must provide:
- Original and photocopy of the DNI, NIE, or passport; for legal entities, the deed of incorporation and documentation accrediting the legal representative.
- Power of attorney, if applicable.
- Title of ownership registered in the Property Registry, with a public deed and an updated simple note.
- In the event of the owner’s death, the will or declaration of heirs, acceptance of inheritance, and forms 650 and 660 of the Inheritance and Gift Tax.
- Electronic notification address when the owner is required to maintain electronic communication in accordance with article 14 of Law 39/2015.
The Delegation requests that this documentation be sent in electronic format through the Electronic Registry before the act, to streamline processing and reduce the duration of each appearance. Until the designated day, affected parties omitted from the list may examine the parcel plans and file allegations to correct errors or omissions.
The publication affects the cited owners, but also the metropolitan area as a whole: the electrification of the entire route between the Pablo de Olavide University and Montecarmelo is the technical condition to complete the modernization of the Alcalá de Guadaíra tram line, a connection axis pending this electrical infrastructure.
