La Junta expropia terrenos en Albendín para la nueva depuradora de Baena

The Territorial Delegation of Agriculture, Fisheries, Water and Rural Development in Córdoba has called for the drawing up of records prior to the urgent occupation of the assets and rights affected by the compulsory expropriation proceedings for the discharge collection project and wastewater treatment plant (WWTP) of Albendín, in the municipality of Baena. The resolution, signed on September 28, 2026, by the territorial delegate Raquel López Moriana, is published in the Official Gazette of the Province of Córdoba number 203, dated October 20, 2026 (reference BOP-A-2026-3322). The owners of the affected estates must appear at the offices of the Baena City Council between November 16 and 24, 2026.

The expropriation file is processed under number 14/001/02/2026 and affects the land necessary to execute the “Construction Project for the discharge collection and WWTP of Albendín, T.M. Baena (Córdoba)”, with key A5.314.1083/2112. The final beneficiary of the expropriation is the Baena City Council. The project was approved by a resolution of the General Directorate of Water Infrastructure on September 7, 2026, with a total budget of 5,789,777.75 euros and an execution period of 18 months.

The process began with the technical approval of the project by a resolution of the General Directorate of Water Infrastructure on April 16, 2026, and the authorization of the Territorial Delegation on May 11, 2026, to submit it for public consultation. The announcement was published in the Official Gazette of the Junta de Andalucía on June 2, 2026, in the BOP of Córdoba on June 17, in the newspaper Córdoba on June 5, and on the notice board of the Baena City Council on June 8. During that period, two objections were submitted, with entry records dated July 14 and 24, 2026, which were dismissed with justification.

Appearance over five days in November

Those summoned must go to the Baena City Council, either in person or through an accredited representative, on the dates and times set out in the annex to the resolution:

The act may continue on subsequent days and times if necessary, with a verbal announcement during the session. Interested parties must present their DNI or NIF and documentation proving ownership (simple note or certificate from the Property Registry, public deed, or the IBI receipt from the last year) and may be accompanied by experts and a notary at their own expense. In the event of non-appearance, the proceedings shall be understood to be with the Public Prosecutor’s Office, in accordance with Article 5 of the Compulsory Expropriation Law.

Affected areas and owners

The attached list comprises 42 properties located in the municipality of Baena (Albendín), in polygons 24, 26, 37, 10012, 12023, 13025, and 13029. The full expropriation areas total more than 9,400 square meters, to which easements and temporary occupations for the execution of the works are added.

  • The property with the largest area is number 58 (polygon 24, plot 43), with 7,960 square meters of expropriation, in the name of Ana María Espartero Jurado and Ángeles Espartero Jurado.
  • Number 56 (polygon 24, plot 45), belonging to Francisco León Lozano, reaches 179.75 square meters of expropriation and 1,650.14 of temporary occupation.
  • Among the owners are also Ravensburgo Corporation SL, Hijos Rosario Onieva CB, Antonio Aguilar Horcas (heirs of), María del Carmen Márquez Porcuna, José Cañete Montes, María de los Ángeles Mellado Dorado (heirs of), and Antonio José Miranda Sánchez, among others.
  • The most extensive temporary occupation corresponds to property 24 (polygon 37, plot 105), with 2,106.87 square meters.

The declaration of public utility and the need for urgent occupation derive from Article 29 of Law 9/2010, of July 30, on Waters of Andalusia, and from the Agreement of October 26, 2010, of the Governing Council, which includes the “Edar and collectors in Baena” among the hydraulic works of interest to the Autonomous Community. The procedure is governed by Article 52 of the Compulsory Expropriation Law of 1954 and by Articles 56 and following of its 1957 regulation.

Until the minutes are drawn up, interested parties may submit written allegations to the Territorial Delegation of Agriculture, Fisheries, Water and Rural Development in Córdoba, at calle Tomás de Aquino, s/n, Córdoba, solely to correct possible errors in the list of assets. During the act itself, acquisition by mutual agreement may be proposed, in accordance with Article 24 of the expropriation law.

Against the resolution, which exhausts administrative remedies, an optional appeal for reversal (recurso de reposición) may be filed before the Counselor of Agriculture, Fisheries, Water, and Rural Development within one month, or a contentious-administrative appeal may be filed before the Contentious-Administrative Chamber of the High Court of Justice of Andalusia within two months.

The call directly affects the economy of dozens of families owning rural plots in Albendín, whose lands will be limited by the construction of a water purification infrastructure considered to be of regional interest. The publication opens the period to review ownership and assigned areas before the preliminary deposits and compensation for rapid occupation are established.
