The Provincial Council of Granada will repeat the stabilization process for Administrative Staff
Por FactBox Admin

The Provincial Council of Granada will execute the final judgment that annuls the professional merit criteria of the stabilization process for the Administrative Subscale and must process a new call for four positions. The resolution, signed by the delegated councilor Mónica Castillo de la Rica, is published in the Official Gazette of the Province of Granada No. 189, dated September 30, 2026, with official reference BOP-GRA-2026-189004.
Resolution No. 5700, dated September 15, 2026, from the Delegation of Tourism, Transparency, Human Resources, and Digital Transformation, complies with Judgment No. 505/2025, dated September 5, 2025, issued by the Administrative Litigation Court No. 2 of Granada in Fundamental Rights Procedure 14/2025, brought at the request of Antonio Manuel Naranjo Martín. The ruling, unfavorable to the provincial interests, was confirmed by Judgment No. 1217/2026, dated May 18, 2026, from the Third Section of the Administrative Litigation Chamber of the High Court of Justice of Andalusia based in Granada, which resolved appeal 1991/2025.
The origin of the litigation is Resolution No. 7693, dated December 11, 2024, from the Delegation of Transparency, Human Resources, and Electronic Administration, which called for selective tests for entry and stabilization of temporary employment in the General Administration Scale, classified in groups C1, C2, and Professional Groupings without degree requirements, published in BOP No. 240, dated December 13, 2024.
Annulment due to violation of fundamental rights
The execution of the judgment annuls criteria 2.1 (“Professional Merits”) and 2.4 (“In case of a tie in the selection process”) of Annex I of specific regulations, due to a declaration of violation of the right to equality under Article 14 of the Constitution and the right to access public functions and positions under equal conditions.
The scope of the ruling is limited to those two criteria of the open entry call for the Administrative Subscale of General Administration, and the effects of the execution shall not be extended to other selection processes, insofar as this could affect third parties not involved in the administrative litigation procedure.
New selection process for four positions
The second resolution orders, in execution of the judgment, the processing and approval of a new offer and call for a selection process for the regulatory provision of four positions in the Administrative Subscale of General Administration, subgroup C1. The execution of the ruling, which annuls the professional merit valuation system, entails the organization of a new process adjusted to the principles of equality, merit, and capacity.
- Annulment of clause 2.1, “Professional Merits”.
- Annulment of clause 2.4, “In case of a tie in the selection process”.
- New call: four positions for the Administrative Subscale of General Administration, subgroup C1.
- Publication on the portal https://dipgra.convoca.online/, “Calls” section, under the heading “New call Stabilization 2023. Administrative (competition)”.
Notification to the court and material execution
The resolution orders the notification of the agreement to the judicial body for the purpose of accrediting compliance with the sentence, as well as forwarding it to the competent administrative services for the material execution of the provisions. The processed file is 2025/PES_01/001114 and the resolution is issued using the delegated powers conferred by article 29 a) of the Recast Text of the legal provisions in force regarding Local Regime, approved by Royal Legislative Decree 781/1986, of April 18.
The signature corresponds to the delegated deputy Mónica Castillo de la Rica, according to the delegation of the Presidency conferred by Resolution no. 5356, of August 25, 2026, with acknowledgment from the General Secretariat in accordance with article 3.2 e) of Royal Decree 128/2018, of March 16.
The agreement directly affects the applicants of the stabilization call for the Administrative Subscale, who will see the professional merit assessment process repeated, and confirms the obligation of the Provincial Council to adjust its selection bases to the constitutional principles of equality, merit, and capacity.
