La Bisbal modifies its staff to comply with the Terracotta Museu ruling

The Plenary of the City Council of La Bisbal d’Empordà unanimously approved, in the session of September 22, 2026, the modification of the List of Job Positions and the staff roster to comply with the ruling recognizing the non-fixed indefinite status of a worker at the Terracotta Ceramic Museum. The agreement is published in the Official Gazette of the Province of Girona no. 190, of October 2, 2026, with the reference BOP-2026_0_190_8423 (pp. 1-4).

The ruling requiring the staff modification

The modification responds to Ruling no. 2113/2026 of the Social Chamber of the High Court of Justice of Catalonia, of April 13, 2026, which dismissed the appeal filed by the City Council of La Bisbal d’Empordà and the Terracotta Ceramic Museum and confirmed the first-instance resolution.

The confirmed ruling is Ruling no. 409/2024 of the Social Court 2 of Girona, of October 30, 2024, issued in the ordinary procedure for the recognition of rights no. 911/2023. It upheld the claim filed by Adela Piera Goñi against the museum and the city council and declared the existence of an employment relationship since July 15, 2003, with non-fixed indefinite status and the inherent legal consequences.

The current List of Job Positions had been approved by the Plenary on June 29, 2010, and published in DOGC no. 5666 and BOP de Girona no. 131, with subsequent modifications.

A new job position at the museum

To execute the resolution, the Plenary approves the creation of a position at the Autonomous Body Terracotta Ceramic Museum with the following characteristics:

• Designation: Documentation and Collections Registry Technician (code 0700).
• Regime: contractual staff, group A2, destination supplement 18.
• Working hours: part-time, 30 hours per week.
• Required qualification: university degree or equivalent; Catalan level C1.
• Selection method: competitive examination (concurs oposició).
• Specific supplement valuation: 312.82 euros.

The main functions include the cataloging and registration of collections, the management of the inventory of museum assets, the research and processing of heritage funds in physical and digital formats, the management of reproduction rights, and support for the museum’s activities and exhibitions.

Background and administrative process

The background of file 2026/000001/1457 (X2026002931) includes:

• The General Negotiation Table of the city council’s public employees, which negotiated the modifications on July 21, 2026.
• The Plenary session of July 28, 2026, where the declaration of urgency for the proposal did not pass, with 7 votes in favor, 5 abstentions, and 4 votes against.
• The Mayoral Decree no. 2026DECR001639, of July 31, 2026, which ordered the registration with the General Treasury of the Social Security on August 1, 2026, of Adela Piera Goñi as indefinite non-permanent labor personnel, assigned to the autonomous body, group A2 and 30 weekly hours.

The agreement also provides for the publication of the modification in the BOP of Girona and in the Official Gazette of the Generalitat de Catalunya, and the transmission of a copy to the State Administration and the Department of Governance. A second announcement in the same bulletin, with the reference BOP-2026_0_190_8425, submits the modification of the staff list to public information for a period of fifteen days; if there are no objections, the initial approval will become final.

The document is electronically signed by the mayor, Oscar Aparicio Pedrosa, on September 24, 2026.

The agreement closes the judicial litigation regarding the employment relationship of Adela Piera Goñi, with recognized seniority since July 15, 2003, and converts an irregular employment situation at the museum into a structural position, with direct effects on the organization of the city council’s personnel and the autonomous body.
