The Anti-Fraud Agency debuts internal regulations consisting of 57 articles and eight titles
Por FactBox Admin

The director of the Prevention and Fight against Fraud and Corruption Agency of the Comunitat Valenciana (AVAF), Eduardo Beut González, approved on October 7, 2026, the Regulations on the operation and internal regime of the body, in development of Law 11/2016, of November 28, of the Generalitat. The regulation is published in the Official Gazette of the Generalitat Valenciana (DOGV) no. 10473, of October 19, 2026, within section I of general provisions, with the official reference DOGV-C-2026-31951, and enters into force the day following its publication, that is, October 20, 2026.
The text replaces the one approved by the Resolution of June 27, 2019, and consists of 57 articles distributed across eight titles, in addition to an annex with the institutional monogram. The authorization to enact it comes from the second paragraph of the first transitional provision of Law 11/2016, which grants the head of the directorate the power to approve and modify the Agency’s regulations. The regulation is limited to regulating the organic structure, internal operation, and personnel regime, without creating new infractions or sanctions.
The processing began with a provision from the general secretariat of the AVAF on September 25, 2025, and included two participation phases: the prior public consultation, announced in the DOGV no. 10205, of September 30, 2025, and the public hearing and information, published in the DOGV no. 10338, of April 9, 2026. The Consultative Legal Council of the Comunitat Valenciana issued Opinion 621/2026, of September 9, 2026, which endorses the project’s compliance with the legal system “provided that the essential observation is addressed.” The file was sent to Les Corts on October 1, 2026.
Three functional areas and a Steering Council
The structure is organized under the direct dependency of the directorate into three functional areas:
- General Secretariat, with the units of Economic, Administrative, and Procurement Management; Information Systems; Prevention; and Training.
- Evaluation, Verification, and Inspection Area, responsible for directing investigations and inspections and evaluating the plausibility of complaints.
- Legal, Whistleblower Protection, and International Relations Area, which assumes legal advice, the instruction of sanctioning and disciplinary proceedings, and defense in court.
The heads of the General Secretariat and the various areas will be selected by the management through a public call among career civil servants. A Management Council is also created, chaired by the director, with assistance and advisory functions, which must meet at least once per quarter. The management may delegate the awarding of contracts with an estimated value of less than 40,000 euros.
Deadlines and guarantees in the investigation
Title IV establishes the investigation procedure, from the preliminary verification to the final report and its resolution. The most relevant time milestones are:
- Preliminary verification and plausibility analysis may not exceed three months from the submission of the complaint, request, or communication; rectification or expansion opens a new three-month period.
- The hearing process regarding the provisional report grants ten business days, which may be extended for another five days upon justification.
- Joint resolutions of inadmissibility will be communicated individually to the informants within a maximum period of ten days.
Nominal and anonymous complaints are permitted, with a guarantee of identity confidentiality, and inspection visits may be carried out without prior notice by accredited personnel. The final resolution may agree to archive the case, formulate recommendations, or transfer it to other bodies, and the Agency will monitor compliance with its recommendations, recording any non-compliance in the annual report or in an extraordinary report to Les Corts.
Informant protection and three separate channels
Articles 14 and 15 regulate the procedure for granting the Status of the Reporting Person and the measures against retaliation, in accordance with Law 2/2023, of February 20, and Directive (EU) 2019/1937. The procedure begins at the request of the informant and culminates in a resolution by the management declaring the protection, admitting it, denying it, or terminating it; possible indications of infringement will be processed in a separate and coordinated sanctioning file.
The regulation requires three distinct and incompatible electronic channels: the General Registry, the Complaints Mailbox —external, with confidentiality and anonymity— and the Internal Channel of the organization itself. The regulation also creates a registry of working condition agreements and provides for the appointment of a Data Protection Officer.
Personnel, teleworking, and economic regime
Regarding personnel matters, the text refers to the Personnel Statute of Les Corts Valencianes, regulating the horizontal professional career in five grades (initial GDP and GDP I to IV), professional accreditation via identification card, and the disciplinary regime, with a separation between the investigative and sanctioning phases. The right to teleworking is recognized, and a plan with common criteria is foreseen, as well as exceptional cases for health emergencies, construction works, work-life balance, or health reasons.
Title VII subjects accounting to the principles of public accounting and the General Public Accounting Plan, requires at least two signatures to dispose of funds, and mandates the quarterly publication of credit modifications in the Official Bulletin of Les Corts Valencianes. The Agency is subject to the Internal Audit of Les Corts and shall justify its management annually before the Sindicatura de Comptes.
The new regulation comes after three reforms of the creation law—Law 27/2018, Law 3/2024, and Law 5/2025, of May 30, which converted the Agency into an independent whistleblower protection authority—and provides the body with a stable framework to investigate corruption within the Generalitat and its instrumental public sector. Its entry into force, one day after publication, clears the organizational uncertainty that the institution had faced since 2019 and reinforces the guarantees for both whistleblowers and those under investigation.
