Arcom formally notifies Europe 1 Télécompagnie to comply with its agreement

L'Arcom met en demeure Europe 1 Télécompagnie de respecter sa convention

Arcom enjoins the company Europe 1 Télécompagnie to comply, in the future, with the provisions of the law of September 30, 1986, and several stipulations of its convention. The injunction is contained in decision no. 2026-549 of October 21, 2026, signed by the Regulatory Authority for Audiovisual and Digital Communication and published in JORF no. 0251 of October 27, 2026, under NOR RCAC2628435S.

Three precise references targeted by the injunction

The formal notice does not refer to a general obligation of good conduct: it cites three sets of provisions that the publisher must respect in the future.

  • The seventh paragraph of Article 15 of the law of September 30, 1986, relating to the freedom of communication.
  • The fourth paragraph of Article 2-4 of the convention of October 25, 2023, binding the publisher to the Authority.
  • Article 2-10 of this same convention of October 25, 2023.

The text published in the Official Journal of the French Republic is limited to this operative part: it details neither the alleged facts, nor the broadcast sequences in question, nor the date of the observed breaches. The decision consists of two articles, one establishing the obligation of compliance, the other providing for its notification to the company and its publication in the Official Journal.

A public act of regulation

The formal notice is one of the instruments available to Arcom when dealing with a publisher holding an authorization: it notes a breach, enjoins its correction for the future, and is then notified to the party concerned and published. Its scope is therefore twofold: individual for the publisher and public for the readers of the Official Journal.

Other decisions of the same type have been published in recent weeks, indicating a common use of this procedure:

  • Lyon Media Plus, formal notice published in the Official Journal of October 13, 2026;
  • Terre Marine, formal notice published in the Official Journal of October 22, 2026.

A national publisher in the midst of authorization renewal

Europe 1 Télécompagnie operates a category E radio service via terrestrial frequency modulation. Its authorization has been the subject of several recent decisions by the Authority, including:

  • decision no. 2026-464 of September 22, 2026, which renews the authorization for five years starting March 30, 2027 (JORF no. 0233 of October 6, 2026);
  • decision no. 2026-513 of October 7, 2026, which renews the authorization for five years starting May 16, 2027 (JORF no. 0241 of October 15, 2026);
  • decision no. 2026-450 of September 16, 2026, which modifies Annex II of decision no. 2025-820 of October 8, 2025, for the Évry site… more precisely for the Embrun area, on the frequency 104.6 MHz (JORF no. 0223 of September 24, 2026).

The formal notice of October 21, 2026, therefore occurs while the service’s operating framework is undergoing review via renewal, without the published document establishing any link between the two procedures.

What this changes for the publisher and for the public

Decision No. 2026-549 imposes neither a suspension nor a financial penalty: it creates an obligation of compliance for the future, enforceable against Europe 1 Télécompagnie as of its notification, and it makes the reminder of the law and the agreement public. For listeners and industry observers, it documents the fact that Arcom has identified, within a national generalist service, deviations from the rules of the law of September 30, 1986, and from the commitments made in the agreement of October 25, 2023, without the details of the facts being made public at this stage.
