The Director of Labor and Social Security has imposed a fine of 7,501 euros on the company Kotrik Industrial LDA, in file number 48/2026/84, for committing a very serious breach of labor regulations. The resolution is dated September 7, 2026, but was notified via an announcement on October 5, which was published in the Official Gazette of the Basque Country (BOPV), issue number 201, on October 21, 2026, with official reference 2026/4419. The deadline for payment of the fine is November 7, 2026.

The notification was processed by the Directorate of Labor and Social Security, under the Department of Economy, Labor and Employment of the Basque Government. Although an attempt was made to notify the company personally, the notification had no effect; therefore, the announcement was published, fulfilling the alternative method provided for in Article 44 of Law 39/2015, of October 1. The announcement was signed by Director María Victoria Portugal Llorente in Vitoria-Gasteiz, on October 5, 2026.

Basis and classification of the penalty

The Director’s resolution approved the penalty proposal contained in the infringement report number I12026000015127e. The infringement is typified in Article 8.2 of the consolidated text of the law on labor infringements and sanctions; this consolidated text was approved by Royal Decree-Law 5/2000, of August 4. The legal classification is “very serious,” which entails the highest level of the penalty range.

The penalized company is Kotrik Industrial LDA, with tax identification PT51560710. The main reference of the file is 48/2026/84, although the annexes of the announcement bear the reference 01/2026/84, which is the only internal inconsistency found in the document.

Appeal and administrative route

The resolution does not exhaust the administrative route. The company may file an administrative appeal (recurso de alzada) before the Undersecretary of Labor and Social Security within a period of one month, starting from the day following the publication of the announcement. If no appeal is filed, the penalty remains as is, and the payment obligation is automatically activated.

How to make the payment

Payment must be made through the Basque Government’s payment gateway at www.euskadi.eus/mipago. The data for the operation are as follows:

  • Collection Procedure Code (CPR): 9050794.
  • Collecting entity: 04833001-522.
  • Reference: 0126008400191.
  • Identification: 071126.
  • Amount: 7,501 euros.

In case of non-payment

If the deadline expires and payment is not made, the administration will initiate enforcement proceedings to collect the fine. From that moment on, an enforcement surcharge and late-payment interest will accrue, applying the procedure established in the Collection Regulations of the General Treasury of the Basque Country, approved by Decree 1/2021, of January 12.

Impact and importance

This has a direct economic consequence for a company, but also legal and reputational consequences: it is an administrative resolution receiving a breach of regulations classified as very serious, and it remains in the public registry. The company has a period of one month to file an appeal or, otherwise, to pay before November 7th; failure to follow either path will lead to the enforcement process and additional costs.
