Vitoria-Gasteiz, October 26, 2026. Kontsumobide-Instituto Vasco de Consumo has imposed a fine of 15,000 euros on the company Calculators & Tools, S.L. for failing to comply with distance contracting obligations and obstructing the right of withdrawal. The penalty is recorded in file SAN-20A001-12-2026, and the resolution was signed by director Ana María Sánchez Herráez on October 1st. Today, October 26th, the notification has been published in issue number 204 of the Boletín Oficial del País Vasco, with official reference 2026/4502.
Kontsumobide is the autonomous body with sanctioning powers in the field of consumption, created by Law 9/2007 and structured via Decree 159/2011. In this case, the company has violated Article 139.22 of Law 4/2007 —the statute of consumers and users— within the section of serious infringements. However, the resolution does not end the administrative route: the company has a period of one month to file an appeal.
Four failures in distance contracting
The resolution groups four behaviors as a single infringement, all of which occur within distance contracting relationships:
- Failure to comply with the deadlines established by distance contracting regulations, both for the delivery of the good or service and for the refund of the amount paid.
- Sending goods, digital content, or services not requested by the consumer, together with a payment request.
- Using communication techniques that require explicit consent or the consumer’s non-opposition, without meeting those conditions.
- Refusal or obstruction of the exercise of the right of withdrawal.
The economic penalty is 15,000 euros. The administration has identified the company as a society with fiscal identification B88111414, and the same file reference must be used in all proceedings.
After failed personal notifications
Since attempts to provide personal notification were unsuccessful, Kontsumobide has notified the resolution via public announcement, as enabled by Article 44 of Law 39/2015. The publication will have effects from the day following its publication and will serve as notification to the interested party. The resolution has been included in the announcements section under the department of Turismo, Comercio y Consumo.
Payment deadlines and method of payment
The deadlines for paying the fine are calculated based on the date of notification:
- Sanctions notified between the 1st and 15th of the month: until the 20th of the following month from the date of notification.
- Sanctions notified from the 16th to the end of the month: until the 5th of the second month from the date of notification.
- If the last day of the period is not a working day, it is extended until the next valid day.
- When making the payment, the identification B88111414 and the file number SAN-20A001-12-2026 must be mentioned, and it must be indicated that it belongs to Kontsumobide.
- If the period for filing an appeal ends later than the general payment period, the payment period is extended until the next valid day after the end of the appeal period, provided that no appeal is filed, according to Article 59 of Decree 1/2021.
Payment and file documentation can be consulted in the personal folder of the Basque Government’s electronic office.
Appeal and administrative route
The company may file an appeal against the decision with the Minister of Turismo, Comercio y Consumo, within a period of one month starting from the day following the receipt of the notification. The appeal does not automatically suspend the obligation to pay the fine, but the payment period is adjusted according to the appeal period as explained in the previous section.
The sanction is not an isolated case: throughout October, Kontsumobide has published several resolutions in consumer affairs files, which shows that the organization is systematically monitoring obligations regarding distance contracts and the right of withdrawal. For the consumer, it is important to know that obstructing the right of withdrawal is an explicitly codified infringement, and not merely a breach of contract. On the part of companies, the resolution reminds us that failure to comply with deadlines and refunds leads to direct economic penalties, including in distance selling channels.
