Kontsumobide-Basque Institute of Consumption has imposed a fine of 10,000 euros on the person identified in file SAN-48A001-7-2026, for committing an infringement in the field of consumption. The resolution was issued on June 18, 2026, by the director of the organization, Ana María Sánchez HerrÁez, and as it could not be notified to the interested party, it was published in issue number 203 of the BOPV official gazette on October 23, 2026, with official reference 2026/4463.

The notification was carried out via a subsidiary method: after attempting to perform the standard notification to the interested party without success, the announcement is published in the official gazette, following the procedure established in Article 44 of Law 39/2015. This publication carries the legal effects of the notification, as stated in the announcements of the Department of Tourism, Commerce, and Consumption.

The Kontsumobide organization was created by Law 9/2007, and its structure is regulated by Decree 159/2011. Sanctioning files in the field of consumption are resolved by the organization’s directorate, and when personal notification is impossible, the means of notifying the resolution is the BOPV. In this case, the resolution was signed in Vitoria-Gasteiz on September 30, 2026.

Sanction and Infringement

The resolution includes the following elements:

  • File: SAN-48A001-7-2026, sanctioning procedure in the field of consumption.
  • Date of resolution: June 18, 2026.
  • Interested party: Person with NIE/DNI 16073247L, without being identified by name.
  • Violated rule: Article 141.1 of Law 4/2023, the Statute of Consumers and Users.
  • Imposed sanction: 10,000 euros.

The annex of the announcement only links two pieces of data: the interested party’s DNI and the file reference. No description of the infringement is provided, nor is the qualification level of the sanction.

Appeal and Payment Deadlines

The resolution does not exhaust the administrative route, and an appeal against it may be filed before the Minister of Tourism, Commerce, and Consumption within a period of one month starting from the day following the notification.

Regarding payment, the deadlines established by Article 59 of Decree 1/2021 are as follows:

  • Sanctions notified from the 1st to the 15th of the month: payment by the 20th of the following month, or if that is not a business day, by the next business day.
  • Sanctions notified from the 16th onwards: payment by the 5th of the second month, or if that is not a business day, by the next business day.
  • If the period for filing an appeal ends later than the general payment period, the payment period is extended until the next business day after the appeal period ends, provided that no appeal is filed.

To make the payment, the DNI 16073247L and the file number (SAN-48A001-7-2026) must be mentioned, and it must be indicated that it belongs to the Kontsumobide-Basque Institute of Consumption. The file documents are available in the electronic office folder of the Basque Government.

Background of the same article

This is not the only case. An announcement published in issue number 198 of the BOPV on October 16, 2026, announced a similar decision in file SAN-20A001-41-2026, where the content of article 141.1 was specified: refusing to facilitate or obstructing inspection work, or failing to provide data requested by the authorities, as well as providing incorrect or incomplete information or presenting false documentation. The penalty imposed in that file was 1,000 euros, ten times smaller.

The text of the announcement itself specifies that the notification will take effect from the following day, but it states that the publication was made in the Boletín Oficial del Estado, even though the announcement was published in the Official Gazette of the Basque Country. This form error has no effect on the validity of the publication, but it is noteworthy in the official text.

The size of the penalty —10,000 euros— indicates that the organization severely punishes the refusal to comply with consumption regulations or the obstruction of inspection, and, at the same time, shows that a large part of the sanctioning files are concluded without notifying the interested party, except through the official gazette. The interested party has a period of one month to file an appeal; if they do not do so, the decision will become final in the administrative route.
