The director of Kontsumobide-Basque Institute for Consumption has imposed a sanction on the company Consorweb, S.L. in a consumer affairs case. The company must pay 11,001 euros, according to the resolution issued in file number SAN-20A001-39-2026. Although attempts were made to notify the party personally, this was not achieved; therefore, the official announcement was published in the Official Gazette of the Basque Country (BOPV) on November 3, 2026, in issue number 210, with public reference 2026/4634.
The resolution was signed in Vitoria-Gasteiz on October 16, 2026, by Ana María Sánchez HerrÁez, director of Kontsumobide-Basque Institute for Consumption. This organization is attached to the department of Tourism, Trade and Consumption, and its main mission is to protect consumer rights: processing claims, enforcing regulations in this field and, when necessary, opening sanctioning proceedings. The notification has been made public using the procedure provided for in Article 44 of Law 39/2015, when personal notification to the interested party cannot be carried out.
Two infractions: abusive clauses and non-provision of paid services
The resolution specifies two infractions, based on two sections contained in Article 139 of Law 4/2023, the Law on the Statute of Consumers and Users:
- 139.1: including abusive clauses in contracts signed by consumers or users, or engaging in abusive practices.
- 139.28: requesting any consideration, price, or payment for goods not delivered or services not provided.
In the administration’s view, the company committed both behaviors, and therefore the sanction was imposed without denying the harmful effect, after analyzing the allegations previously stated by the company itself. The resolution also informs the company that when paying the fine, it must mention the NIF and the file number, and state that the amount belongs to Kontsumobide-Basque Institute for Consumption. The documentation is available to the company at the Basque Government’s electronic office.
Amount of the fine and payment deadlines
The economic penalty is 11,001 euros. The payment deadlines are calculated according to the date of notification, following general regularization rules:
- Fines notified from the 1st to the 15th of the month: can be paid until the 20th day of the month following the notification date, or if that day is not a working day, until the next working day.
- Fines notified from the 16th to the last day of the month: until the second month following the notification date, specifically until the 5th day of that month or, if it is not a working day, until the next working day.
Article 59 of the Accounting Regulation of the General Treasury of the Basque Country, according to Decree 1/2021, specifies that if the period for filing an appeal ends later than the general payment period, the payment period is extended until the appeal period expires, provided that no appeal is filed. Therefore, the company must organize the payment date according to the moment of notification to avoid late-payment interest.
Consequences of the appeal and resolution
The fine does not exhaust the administrative route. The company, therefore, may file an appeal before the department of Tourism, Commerce and Consumption, provided it is within one month from the day following the publication of the notification. The resolution will not be final until that period expires or the appeal is resolved.
The notification states that this announcement produces legal effects from the day following its publication. The annex contains the company’s identification: Consorweb, S.L., NIF B98586720 and reference SAN-20A001-39-2026. That is, the name, tax identification, and file number appear linked together, which facilitates public control over the company.
Decision strengthening consumer protection
The decision reaffirms that Kontsumobide controls the transparency of contracts and the actual provision of services, and that although the penalties are proportional, they are not insignificant: a fine of 11,001 euros is significant for medium or small-sized companies. For consumers, the news shows that companies cannot impose excessive conditions, cannot charge for something they have not delivered or provided, and that rule-breaking has clear financial responsibility. Publication in the BOPV, furthermore, publicly links the company’s name and NIF, as a way to restore public trust.
