Køge Kommune seeks property judgment for Sædder plots in Tureby

Køge Kommune is asking Tinglysningsretten to declare it the rightful owner of two plots in Sædder that have no registered titleholder, and the land registration court has allowed a public summons of anyone who claims rights to them. The summons was published in Statstidende on 4 November 2026 as document S02112026-278, and it sets a court hearing in Hobro on 7 January 2027 at 11:00.

The notice rests on a ruling — a kendelse — issued by Tinglysningsretten on 18 September 2026, which permitted the court to call publicly on the person or persons who consider themselves entitled as adkomsthaver to the property. The procedure is the one laid down in Tinglysningsloven § 52a, stk. 3: if no objection is raised, the court may order a note in the land register (tingbogen) in accordance with the content of the summons.

The case concerns an unregistered property right rather than a dispute between known parties. According to the notice, the adkomsthaver recorded in the tingbog is entered simply as Byens Gade, which is why the court is summoning anyone whose interests are affected — including owners and users of the adjacent properties who consider themselves entitled — to appear and substantiate a claim.

The two plots at Ringsbjergvej 998

  • Matriculation: matr.nr. 44a and 44b, Ringsbjerg By, Sædder.
  • Address: Ringsbjergvej 998, 4682 Tureby.
  • Titleholder recorded in the tingbog: Byens Gade.
  • Outcome sought: an ejendomsdom recognising Køge Kommune as the rightful owner.
  • Legal basis cited: Tinglysningsloven § 52a, stk. 3.

In practice the notice gives the municipality a route to a clean registered title over land it claims but cannot document through a chain of deeds. The document is labelled “Ny 1. indkaldelse” — the first summons in the case — and states that anyone with objections to the municipality obtaining a property judgment is called to the hearing on the request.

Hearing in Hobro on 7 January 2027

  • Date and time: 7 January 2027, 11:00.
  • Venue: Tinglysningsretten, Majsmarken 5, 9500 Hobro.
  • Court reference to be quoted: j.nr. 26/26187.
  • Objections: in writing to Tinglysningsretten, optionally through the court’s contact form on tinglysningsretten.dk, before the hearing or at the latest during it.
  • Follow-up: if objections are filed, a new hearing will be convened to deal with them.

The notice is explicit that objections must cite the court’s reference number, and that a sitting will be arranged to process any objection submitted. Silence carries consequences: if no objection appears by the hearing, the court is expected to grant the property judgment as requested.

What happens if nobody objects

Where no interest is asserted, the court is expected to issue the ruling registering the position in the tingbog in line with the summons, or to grant the ejendomsdom the municipality has applied for. The notice is signed on behalf of Køge Kommune in Køge on 2 November 2026 by Nanna Louise Mikkelsen.

For readers around Tureby and Sædder the notice is a deadline with legal effect: owners and users of neighbouring land who believe they hold a better right to matr.nr. 44a and 44b have until the January hearing to prove it, or the plots will stand in the land register as municipal property. Because the court summoned the public rather than serving named individuals, anyone relying on an old deed, an inheritance or long use must come forward on their own initiative.
