Jaén approves the remote work regulations for its municipal public employees

Jaén aprueba el reglamento de teletrabajo para sus empleados públicos municipales

The Jaén City Council has definitively approved the Teleworking Regulations for the council and its Autonomous Bodies, which regulate the non-presential working day for all municipal personnel. The regulation is published in full in the Official Gazette of the Province of Jaén number 184, dated September 22, 2026, under reference 2026/4408, occupying pages 14042 to 14069. The text is effective indefinitely from the day following its publication and voids all teleworking authorizations granted until now.

The Plenary of the Jaén City Council initially approved the regulation in an ordinary session on September 30, 2025. The file was subject to public consultation for 30 days via an announcement in the Official Gazette of the Province of Jaén number 205, dated October 27, 2025. Once the submitted allegations and claims were resolved, final approval took place in the ordinary session on July 31, 2026, in accordance with article 70.2 of Law 7/1985, of April 2, Regulating the Bases of the Local Regime. The announcement is signed by Carlos Alberca Martínez, Fifth Deputy Mayor Delegated to the Human Resources Area, in Jaén on August 2, 2026.

A teleworkable workday of up to 60% weekly

The regulation sets the teleworkable workday at a maximum of 60% of the total workday on a weekly basis, concentrated from Tuesday to Thursday, except for rotation positions and extraordinary causes. The weekly distribution is as follows:

  • Minimum of one day per week (Tuesday, Wednesday, or Thursday) from the Teleworking Office, with the remainder being in-person.
  • Maximum of three days per week in this modality.
  • Maximum of two days for Head of Service positions or similar.

The authorization has a maximum duration of one year from the start date set in the resolution, renewable for equal periods as many times as desired if the conditions of the Individual Teleworking Plan are met. The modality is voluntary and in no case affects remuneration.

Personnel requirements and excluded positions

Civil servant and contractual personnel in active service with at least nine consecutive months of seniority in the position, who perform tasks capable of being carried out remotely and demonstrate sufficient computer skills, may request it. Due to their characteristics, the following are excluded:

  • Registry and citizen attention and information positions of an in-person nature.
  • Positions assigned to public safety services.
  • Temporary workers and high-ranking officials.
  • Concierge, security, opening and closing of facilities, maintenance of buildings or public vehicles, teaching of activities or disciplines, and the Home Help Service.

Authorization, deadlines, and time control

The application is submitted exclusively electronically via the electronic office, addressed to the Mayor-Presidency or the Presidency of the Autonomous Body, and is processed using the MyTAO system. The projected deadlines are:

  • 10 business days for Human Resources to forward the application to the corresponding section (5 business days in Autonomous Bodies).
  • 15 business days for the mandatory, reasoned, and non-binding report from the head of the section.
  • One month without a notified resolution: the application is understood to be rejected.

Authorization corresponds to the Deputy Mayor Delegated for Human Resources in the City Council and to the President in each Autonomous Body. Due to service needs, presence may be required with 24 hours’ notice (12 in exceptional cases) and, in case of urgency, the teleworker must report to their workstation within one hour maximum.

Monitoring and Equipment Commission

A joint Monitoring Commission is created, chaired by the Mayor-President or their delegate, with one representative from each union with representation on the general negotiating table, the General Secretariat, and a Human Resources technician, both with voice but no vote. The council will provide, subject to the availability of the IT Service, computer equipment with an autonomous connection, a briefcase, computer applications, a secure remote teleworking solution, and a telephone. The use of connections from shops, hospitality establishments, or networks shared with the public is prohibited. Expenses for equipment, connection, electricity supply, chairs, or office materials will not be remunerable or financially compensable.

The regulation affects all civil service and contractual staff of the Jaén City Council and its Autonomous Bodies and replaces the previous framework: upon entering into force, current authorizations are annulled and must be processed again according to the procedure in Chapter II. The regulation also incorporates the right to digital disconnection and the occupational risk assessment of the remote position.
