Jávea regulates tourist rental homes and excludes complexes and blocks
Por FactBox Admin

The Jávea City Council has published in the Official Gazette of the Generalitat Valenciana (number 10474, dated October 20, 2026) the favorable strategic environmental and territorial report regarding the specific modification number XLI of the municipality’s General Urban Development Plan (PGOU), intended to regulate tourist rental homes. The agreement was adopted by the Municipal Environmental Evaluation Commission in its ordinary session CEAM-2026/01, held on May 12, 2026, and the announcement is signed by the mayor, Rosa Vicenta Cardona Vives, dated September 24, 2026. The document is identified by the official reference DOGV-C-2026-30483.
Environmental green light in simplified procedure
The commission issued a favorable strategic environmental report in the simplified procedure of the modification, pursuant to article 49 of the recast text of the Law on Land Use, Urban Planning and Landscape (TRLOTUP), considering that the proposal “does not have significant effects on the environment.” The processing must now continue through the corresponding sectoral channel.
The agreement expressly incorporates the considerations submitted by the Directorate General of Tourism in a report dated April 29, 2026, which condition the final content of the modification.
Complexes and blocks excluded from the scope
The first criterion from Tourism is decisive for the scope of the regulation: tourist-type homes cannot be included in complexes and blocks, as they constitute another modality of tourist accommodation according to sectoral regulations. Therefore, those complexes and blocks are excluded from the scope of the proposed modification.
The second criterion affects the naming and use of municipal control instruments:
- The creation of a census or list of tourist accommodations with a municipal enabling title shall not be called the Registry of Tourist Homes.
- Alternatively, another instrument with urban planning and local control purposes may be defined.
- This instrument will also serve to verify compliance with saturation percentages by zone.
Three sectoral reports before initial approval
The commission agreed to request, during the initial approval phase by the corporation’s Plenary, sectoral reports from the following bodies:
- Department of Industry, Tourism, Innovation and Trade.
- Territorial Urban Planning Service – Alicante.
- Provincial Coastal Service Alicante.
The announcement is made public in accordance with article 53.7 of Legislative Decree 1/2021, of June 18, which approves the TRLOTUP. The full text of the report is available at the municipal offices at Portal del Clot, number 2, in Jávea, and on the municipal electronic headquarters.
Four-year term
The strategic environmental and territorial report shall lose its validity and cease to produce its effects if, once published in the Diari Oficial de la Generalitat Valenciana, the plan has not been approved within a maximum period of four years from its publication. In such a case, the promoting party must restart the simplified strategic environmental and territorial evaluation procedure.
The decision directly affects homeowners operating tourist rentals, residents of residential centers, and the local hospitality sector, who now face the initial approval phase and the prior sectoral reports. The exclusion of complexes and blocks limits the scope of the regulation to single-family or detached housing, while the control of saturation by zones remains pending the municipal instrument that replaces the tourist housing registry.
