Ingenio approves the expropriation of land to expand its cemetery
Por FactBox Admin

The Local Government Board of the Illustrious City Council of Ingenio, in an ordinary session on October 30, 2026, definitively approved the expropriation procedure by joint appraisal of the lands included in the General Equipment System SGEQ Ingenio Cemetery and the portion of the road on El Almud street. The agreement, adopted unanimously, is published in the Official Gazette of the Province of Las Palmas number 133, of November 6, 2026 (announcement 3.011, registry 2.242.465), within file 2068/2026, and entails the declaration of urgency for the occupation of the affected assets and rights.
The definitive approval comes after the Mayor’s Office-Presidency initially approved the file on March 5, 2026, with a one-month public exhibition via announcements in the official gazette and in one of the island’s widest circulation newspapers, published on March 19 and April 3, 2026. The authority to resolve corresponds to the Local Government Board by delegation of the Plenary adopted in an extraordinary session on July 3, 2023, in accordance with article 3.4 of the Regulations of the Compulsory Expropriation Law.
Six written objections and three partial approvals
During the process, six written objections were submitted, registered between March 12 and May 4, 2026, resolved in the agreement now published:
- RC-2.736 and RE-2.845 (March 12): partially approved, to correct the ownership percentages of estate 3.
- RC-3.270 (March 26), RC-3.606 (April 6) and RE-3.920 (April 10): dismissed.
- RE-5.005 (May 4): first objection, regarding the property structure, partially approved; second and third objections dismissed.
The technical report supporting the resolution, issued on October 21, 2026, argues that the lands of the general system are in a basic rural land situation and rejects the claimants’ thesis that they should be valued as urbanized. The appraisal was commissioned to Actúa Valoraciones, S.L. (CIF B-76157734), which set a unit land value of 15.06 euros/m2, and the Administration dismisses the party expert report signed by Rafael Eduardo Perera Lozano, registered architect number 2049.
1,830 square meters of general system and 35.49 of road
The affected estate is number 3, in its portions A and B, segregated from cadastral plot 35012A00300486, in the area of La Montañeta, with a parent surface area of 3,691 m2 and cadastral ownership held by Concepción Pérez Navarro.
- Property 3A: 1,830 m2 allocated to the general system, assigned to sector SUSNO-T2; fair price of 27,559.80 euros plus 1,377.99 euros as an affection premium.
- Property 3B: 35.49 m2 of consolidated urban land allocated for a road; 4,097.49 euros plus 204.87 euros as an affection premium.
- Total property 3: 33,240.15 euros, including the 5% affection premium.
The resolution authorizes the expenditure derived from the final approval for 68,015.93 euros, which covers the entirety of the project across four private properties, and grants interested parties ten days to provide the registry certification or the supporting titles of their right, including the note from Article 32 of the Mortgage Regulations.
Urgency of occupation and twenty days before Canarias
The final approval implies the declaration of urgency of occupation, such that the Administration may take possession of the land without waiting for the resolution of the fair price. Interested parties have twenty days to submit allegations before the Valuation Commission of the Canary Islands, which will issue the final resolution on the fixing of the fair price; if no opposition is filed within that period, the approved valuation will be deemed accepted. An optional appeal for reversal may be filed against the agreement within one month, or a contentious-administrative appeal within two months. The announcement is signed by the Mayor-President by delegation, the delegated councilor Rayco Nauzet Padilla Cubas (Decree 4,328/2023, of June 20).
The objective: expanding a cemetery at its capacity limit
The file responds to the need to expand the current Ingenio Cemetery, on Avenida de la Gloria, whose capacity is running out. The General Planning Plan, approved in 2005 and published in the Official Gazette of the Province of Las Palmas number 103, of August 15, 2005, delimits the general system with an area of 3,635 m2, assigned to two developable land sectors. The City Council is also processing a Provisional Municipal Ordinance drafted by Gesplan, S.L. (file 8325/2023), initially approved by the Plenary on December 22, 2025.
The agreement clears the availability of the land that the City Council needs to certify the execution project for the expansion. For the owners of property 3, this step enables the collection of the fair price—still pending registry documentation and the eventual review by the Valuation Commission of the Canary Islands—and confirms that the occupation precedes the closing of the valuation file.
