Industry dismisses Torrent 29 269 photovoltaic project due to unfavorable reports

The Territorial Service of Industry, Energy and Mines of Valencia has dismissed the application from Frajav Solar Investment One, SL for prior administrative authorization and administrative construction authorization for the Torrent 29 269 photovoltaic plant and its evacuation infrastructure, with an installed capacity of 1.2 MW, in the municipality of Torrent (Valencia). The resolution, signed on August 3, 2026, is published in the Official Gazette of the Generalitat Valenciana (DOGV) no. 10458, of September 24, 2026, within the administrative acts of authorizations and concessions, with official reference DOGV-C-2026-29528. The processed file is ATALFE/2022/45/46.

The decision is based on Decree-law 14/2020, of August 7, of the Consell, regarding measures to accelerate the implementation of renewable energy utilization facilities, whose article 25.2 requires that the report on land use planning and landscape be favorable in order to grant the authorizations. This report is binding according to article 2 of the same decree-law. The process began with the application submitted on 08/29/2022 (registry GVRTE/2022/2717043) and was admitted for processing on 02/16/2023, with retroactive effect from 11/20/2022. The project was submitted for public information in DOGV no. 10036, of 01/30/2025, and in the Official Gazette of the Province of Valencia no. 22, of 02/03/2025.

Characteristics of the projected installation

• Owner: Frajav Solar Investment One, SL.
• Installed capacity: 1.2 MW (1,452 kWp peak power of the modules).
• Technology: solar photovoltaic, with 2,640 monocrystalline 550 Wp modules on a fixed structure.
• Central inverter with a nominal power of 1,400 kW, limited to 1,200 kW via software configuration with a PPC accessory.
• Prefabricated outdoor transformation center with a 1,600 kVA transformer (540 V/20,000 V).
• Underground evacuation line of 294.50 meters, with HEPR-Z1 12/20 kV 3x240 mm² aluminum conductor.
• Location: polygon 26, plots 269 and 9030, in the municipality of Torrent.

The reports that blocked the file

In response to the consultations of article 24 of Decree-law 14/2020, several reports were received:

• I-DE Redes Eléctricas Inteligentes, SAU, reported on 02/07/2025 that evidence of direct and easy access to the transformation center, as required by ITC-RAT 19, was missing; on 07/09/2026, it reiterated its non-compliance because the enclosure is within the plant perimeter.
• The Territorial Risk Management Service (report dated 03/17/2025) conditioned its favorable opinion on relocating panels, adopting drainage measures, and setting back the fencing according to the PATRICOVA cartography.
• The Landscape Service (04/30/2026) pointed out that it is the responsibility of the city council to issue the report on landscape matters.
• The Torrent City Council considered the use compatible with the planning (01/15/2025) and without environmental concerns (01/23/2025), while the Directorate General of Natural and Animal Environment (03/11/2025) issued a favorable opinion with conditions and the Territorial Planning Service (04/07/2025) found it compatible.

Unanswered requirements and appeal process

The territorial service requested the documentation required by those reports from the developer on several occasions: on 06/19/2025, with proof of non-appearance on 06/30/2025, and through hearing procedures on 10/29/2025 and 06/17/2026. On 11/12/2025, the owner provided an access plan, a responsible declaration, and a draft agreement with I-DE, but did not respond to the other reports nor submit the modified project with the conditions, according to the resolution. Against the agreement, which does not end the administrative route, an administrative appeal (recurso de alzada) may be filed before the Directorate General of Energy and Mines within one month from the day following its notification. The resolution is signed by Roberto Javier Anchel Añó, head of the Territorial Service of Industry, Energy and Mines of Valencia.

The rejection confirms that the Generalitat will not authorize photovoltaic plants without a favorable and binding report on territorial planning and landscape, nor without access to the transformation center that complies with ITC-RAT 19, a requirement that had already stalled the Torrent project since 2025. For the renewable sector and for the municipality, the case illustrates the weight of territorial, floodability, and grid connection constraints in the processing of low-power installations.
