Industria acepta el desistimiento de la fotovoltaica ISF El Fondo Benifaió Solar

The Territorial Service of Industry, Energy and Mines of Valencia has accepted the withdrawal submitted by Energia Ocasus, SLU and has declared the procedure for prior administrative authorization, administrative construction authorization, and declaration of public utility of the photovoltaic installation ISF El Fondo Benifaió Solar, of 5.485 MW, in the municipal terms of Benifaió and Picassent, as concluded. The decision was adopted by resolution on July 3, 2026, and is published in the Official Gazette of the Generalitat Valenciana (DOGV) number 10469, of October 13, 2026, section III, with official reference DOGV-C-2026-29627.

A 5.485 MW plant between Benifaió and Picassent

The projected installation, promoted by Energia Ocasus, SLU (NIF B16894206), was processed under file ATALFE/2022/46/46, the application for which was received on August 29, 2022. Its main characteristics are:

  • Installed capacity: 5.485 MW.
  • Granted access capacity: 5 MW.
  • Technology: photovoltaic.
  • Generating groups in Picassent: polygon 21, plots 42, 43, 44, 46, 415 and 9017.
  • Generating groups in Benifaió: polygon 2, plots 15, 16, 18, 19, 20, 22, 23, 25, 26, 27, 31, 32, 33, 37, 106, 107, 116, 260, 261, 307, 308, 318, 321, 323, 9013, 9014, 9010, 9015 and 9095.

The competence to instruct and resolve corresponds to the Generalitat Valenciana, as the installation is located entirely within the territory of the Valencian Community, in accordance with Decree 49/2026, of April 10, and Order 3/2024, of April 16. The procedure was governed by Chapter II of Title III of Decree-law 14/2020, of August 7, and by Law 24/2013, of December 26, of the electricity sector.

Chronology of a four-year processing period

The admission for processing was issued on January 30, 2023, solely for the purposes of Article 1 of Royal Decree-law 23/2020, of June 23. The public information announcement was published in the DOGV number 10086, of April 11, 2025, in the Official Gazette of the Province of Valencia number 70, of April 11, 2025, and in the newspaper Las Provincias on April 20, 2025.

During the process, reports were received from Red Eléctrica de España, i-DE Redes Eléctricas Inteligentes, SAU, the General Directorate of Natural and Animal Environment, the Benifaió City Council, ADIF Alta Velocidad, the Territorial Risk Management Service, the Júcar Hydrographic Confederation, and the State Road Demarcation in the Valencian Community, among others, as well as allegations from irrigation communities and private individuals.

On September 25, 2025, the holder submitted a modified project to incorporate the received conditions and change some of the affected plots. The Territorial Service issued requests for correction on February 5 and April 23, 2026, which were answered by the promoter on February 27 and May 15, 2026.

The Landscape report and the promoter’s withdrawal

On May 28, 2026, the report from the Landscape Service of the Directorate General of Urbanism, Landscape and Environmental Assessment was received, which was favorable but conditional. It required the correction of the landscape integration study, justification of public participation, expansion of integration measures, and correction of the decommissioning and restoration plan; furthermore, it conditioned the aerial section of the evacuation line on the justification of its technical and economic infeasibility as an underground solution.

On May 18, 2026, the holder had submitted a request for progress due to the proximity of the expiration of the fourth milestone of Royal Decree-Law 23/2020, and on May 19, 2026, the feasibility report from the State Roads Demarcation regarding the impact on the A-7 highway was received.

On June 4, 2026, the writing from Energia Ocasus, SLU was received requesting the withdrawal from the proceedings and the cancellation and return of the financial guarantee number 462021V1417 (payment letter 4695001048903). The promoter alleged impeding causes for construction not attributable to their party, derived from landscape conditions regarding vegetation cover, agricultural trees, setbacks, and vegetation screens.

What the resolution says

The RESOLVE section of the resolution, supported by articles 84 and 94 of Law 39/2015, of October 1, agrees to accept the withdrawal outright, declare the procedure concluded, and archive the proceedings of file ATALFE/2022/46/46. The resolution will be published in the DOGV and in the Official Gazette of the Province of Valencia, and will be notified to the holder, the intervening administrations, and the interested parties.

The cancellation and return of the guarantee is not the object of this procedure, processed in file ATALFE/2022/46/46, and must be requested through the specific procedure enabled at the Generalitat headquarters. An administrative appeal may be filed against the resolution, which does not end the administrative route, before the Directorate General of Energy and Mines within one month. The document is signed by Roberto Javier Anchel Añó, head of the Territorial Service of Industry, Energy and Mines of Valencia.

The withdrawal of ISF El Fondo Benifaió Solar follows that of the neighboring plant ISF Campellos Benifaió Solar, which has a capacity of 5 MW and is promoted by Energía Caelum, SLU, accepted by resolution on July 2, 2026, and published in the DOGV on September 14, 2026. Both projects shared the 20 kV evacuation line and the impact on the A-7 highway.
