INDECOPI imposes definitive antidumping duties on Chinese toilets for five years
Por FactBox Admin

The Commission on Dumping, Subsidies, and Elimination of Non-Tariff Trade Barriers of the National Institute for the Defense of Competition and the Protection of Intellectual Property (INDECOPI) imposed definitive antidumping duties of up to US$ 14.3 per unit on imports of “one piece” ceramic toilets originating from the People’s Republic of China, for a period of five years. The decision is contained in Resolution No. 244-2026/CDB-INDECOPI, adopted in a session on September 30, 2026, and published in the official newspaper El Peruano on Tuesday, October 6, 2026, in the Legal Norms section (p. 22). The regulation comes into effect the day following its publication.
The origin of the case
The procedure was opened at the request of the national producer VSI Industrial S.A.C. (Vainsa), which on December 19, 2024, requested the Commission to initiate an investigation into alleged dumping practices in exports of ceramic toilets to Peru. Through Resolution No. 046-2025/CDB-INDECOPI, published in El Peruano on April 6, 2025, the Commission ordered the start of the investigation under Case File No. 032-2024/CDB, under the framework of the WTO Antidumping Agreement and Supreme Decree No. 006-2003-PCM, modified by Supreme Decrees No. 004-2009-PCM and No. 136-2020-PCM.
The technical analysis was compiled in Report No. 064-2026/CDB-INDECOPI, prepared by the Technical Secretariat of the Commission, which forms an integral part of the resolution. On August 7, 2026, the Commission approved the Essential Facts document, and on September 11, 2026, the hearing for the final stage of the procedure was held.
Duties to be paid by exporters
The resolution imposes a specific duty per unit, depending on the exporter or producer:
- Chaozhou Romance Ceramic Technology Co., Ltd.: US$ 5.7 per unit.
- Chaozhou Farns Ceramics Industrial Co., Ltd.: US$ 14.3 per unit.
- Chaozhou Yatao Ceramics Co., Ltd.: US$ 12.7 per unit.
- Other exporters: US$ 14.3 per unit.
Toilets designated as “smart” and ceramic toilets for boats and other recreational vehicles are excluded from payment. The investigated product enters the Peruvian market, for reference, under tariff subheadings 6910.10.00.00 and 6910.90.00.00.
Dumping and injury to national production
The Commission determined that Vainsa and Corporación Cerámica S.A. (Trebol) constitute the domestic industry (DI). For the determination of dumping, the period January - December 2024 was considered, and for the injury and causal link, the period January 2021 - December 2024.
Dumping margins of 15.2% for Romance, 45.2% for Farns, and 26.8% for Yatao were verified, all above the de minimis level of Article 5.8 of the Anti-Dumping Agreement. Key findings include:
- Chinese imports grew by 56.9% in absolute terms and 126.5 percentage points relative to national production.
- The landed price of imports was, on average, nearly 40% below the domestic selling price of the DPN, with the highest level of undervaluation in 2023 (49.8%).
- The DPN’s market share fell by 12.6 percentage points during the analysis period.
- The DPN’s operating profit remained in negative territory in 2024.
The Commission also dismissed the challenges raised by Homecenters Peruanos S.A., Inversiones CyS S.A., Tinas & Cerámicos Hugo S.A.C., Huancor Perú S.A.C., Engally Trade S.A., Farns, Romance, and the China Chamber of Commerce of Metals, Minerals & Chemicals Importers & Exporters against the resolution that opened the investigation.
Validity and notifications
The measure will have a duration of five (5) years. The resolution provides to conclude the procedure, notify the appearing parties, and bring the decision to the attention of the National Superintendency of Customs and Tax Administration (SUNAT) for the corresponding purposes. Report No. 064-2026/CDB-INDECOPI will be published on the INDECOPI institutional portal.
The resolution involves the intervention of Commission members Gonzalo Martín Paredes Angulo, who presides over it, Manuel Augusto Carrillo Barnuevo, and Carlos Gustavo Carrillo Mora.
The increased cost of imported toilets will be passed on to hardware stores, construction companies, and final consumers, while the measure seeks to give Vainsa and Trebol a five-year period to recover competitiveness against Chinese imports which, according to the case file, were sold below the national production cost.
