Haro notifies the court order authorizing entry into three ruinous properties

The Haro City Council has collectively notified court order 82/2026, dated August 31, 2026, which authorizes entry into the properties located at Colón Street number 1 and Linares Rivas Street numbers 2 and 4. The notification is published in the Official Gazette of La Rioja number 184, dated September 24, 2026, page 16348, section III, with official reference BOR-A-20260924-III–3628. The announcement is addressed to the occupants and title holders who could not be located for personal notification.

The announcement, identified by number 202609210124595 and code III.3628, is issued due to the impossibility of carrying out the notification expressly, in compliance with articles 44 and 46 of Law 30/2015, of October 1, on the Common Administrative Procedure of Public Administrations, as cited in the published text. The resolution is signed by the mayor-president Guadalupe Fernández Prado in Haro, on September 21, 2026.

The complete file remains available to interested parties at the offices of the Haro City Council, located at Plaza de la Paz, 1, during public office hours. The announcement is inserted in the Official State Gazette (BOE), the Official Gazette of La Rioja (BOR), and the municipal Electronic Office.

• Title holders and heirs unknown or whose whereabouts are unknown of Linares Rivas number 2, with cadastral references 2739201WN1124S0001MF, 2739201WN1124S0002QG, 2739201WN1124S0003WH and 2739201WN1124S0004EJ, heirs of the deceased María Concepción Jiménez Jiménez.
• Cadastral references 2739201WN1124S0005RK, 2739201WN1124S0006TL, 2739201WN1124S0007YB, 2739201WN1124S0008UZ and 2739201WN1124S0009IX, heirs of Esmeraldo López Riaño.

From imminent ruin to the court order

The origin of the procedure is the imminent ruin declaration file number 1886145X of the property at Linares Rivas 2. By resolution of the Mayor’s Office dated August 27, 2026, published in the BOR number 168, dated September 2, 2026, page 15140 (reference BOR-A-20260902-III–3371), imminent ruin was declared due to physical danger and a certain risk of detachment and collapse of its structural elements onto the public road, and the property owner was required to carry out demolition within 48 hours.

Subsequently, by resolution of September 11, 2026, published in the BOR number 181, of September 21, 2026, page 16227 (reference BOR-A-20260921-III–3589), a non-extendable period of fifteen business days was granted to provide documentation. The community of owners, represented by Natividad Bañares Salinas, Francisco José Rodríguez Alonso, and Fernando Rodríguez Alonso (writing R.E. 10427, of September 2, 2026), expressed their will to acquire all shares and assume the drafting of the project, the management, and the execution of the demolition.

Technical requirements and municipal warnings

The resolution of September 11 required proof of ownership and representation through a public deed of property, minutes of the community of assets or registry certification, and a notarized power of attorney for the representation of absent co-owners. Additionally, it required technical and security commitments:

• Appointment of the project management and execution management by a competent technician, with professional association endorsement or a responsible declaration.
• Formal commitment to the drafting of the demolition project or a copy of the professional services contract.
• Designation of the health and safety coordinator for the execution phase of the works.

The Haro City Council warned that, if the documentation is not provided or if an unjustified delay is observed that puts the safety of people or property at risk, it will proceed immediately with the subsidiary execution of the demolition in accordance with Article 102 of Law 39/2015. The technical costs, security measures, and demolition will be charged in full and jointly to all registered owners, with collection via the enforcement procedure in case of non-payment.

The publication of order 82/2026 enables entry into the dwellings and closes the administrative sequence opened by the imminent ruin, therefore directly affecting the owners and occupants of Colón 1 and Linares Rivas 2 and 4. Against the previous acts, an optional appeal for reversal may be filed within one month, or a contentious-administrative appeal before the Contentious-Administrative Court of Logroño within two months.
