Guía de Isora extends commercial opening hour freedom to the entire municipality

Por FactBox Admin

Guía de Isora amplía a todo el municipio la libertad horaria comercial

The Vice-Ministry of Industry, Trade, and Consumption of the Government of the Canary Islands has extended the exception to the general commercial hours regime to the entire municipality of Guía de Isora, which since 2015 only covered the centers of Playa San Juan, Alcalá, and Varadero. The measure, signed by Vice-Minister Felipe Afonso El Jaber on September 26, 2026, is published in the Official Gazette of the Canary Islands (BOC) No. 202, of October 8, 2026, in section III of Other Resolutions (document no. 3482, pages 36484 et seq.). The resolution takes effect from the day following its publication, namely, October 9, 2026.

From a partial declaration in 2015 to the entire municipality

The starting point is the Order of April 21, 2015, from the then Ministry of Employment, Industry, and Trade (BOC No. 83, of May 4, 2015), which declared only the coastal centers of Playa San Juan, Alcalá, and Varadero as high tourist influx zones. The City Council of Guía de Isora requested on June 1, 2026 (general entry no. 1184273/2026) to extend this exception to the entire municipality, accompanied by a justifying report on the tourist diversification of the territory.

The resolution does not create a new declaration, but rather expands the existing one and integrates the coast, the midlands, and the interior into a single territorial regime. The competence belongs to the Autonomous Community in application of article 5.1 of Law 1/2004, of December 21, on Commercial Hours, and article 12.4 of Legislative Decree 1/2012, of April 21, which attribute to the minister competent in trade matters the determination of these zones, upon proposal by the city councils, after hearing from consumer associations and business and trade union organizations, and following a report from Tourism.

7,327 tourist beds and 299 restaurants as the basis for the decision

The report from the Head of the Tourist Planning Service, issued on July 7, 2026, and the Ministry’s Tourist Information System support the expansion with these figures for the municipality:

  • 8 hotel establishments.
  • 907 non-hotel establishments.
  • 7,327 tourist accommodation beds.
  • 299 catering establishments.

To this are added, according to the file, the historical complexes of Guía de Isora and Aripe-Chirche and the archaeological zone of Aripe, recognized as Assets of Cultural Interest, a network of trails and protected natural spaces, and an annual calendar of events such as Pascua Florida, the Day of Traditions of Chirche, the Wine Competition, and the Tapas and Wine Night. The resolution also recognizes the functional integration of the municipality into the tourist axis of southern Tenerife and the inter-municipal mobility of visitors and temporary residents.

Allegations from employers, trade unions, and the Chamber

During the hearing process, Comisiones Obreras (CCOO), the Unión General de Trabajadores (UGT), the Nivaria Consumers and Users Association, the Canary Islands Consumers Association-Aconis, the Official Chamber of Commerce, Industry, Services and Navigation of Santa Cruz de Tenerife, and the Provincial Confederation of Employers of Santa Cruz de Tenerife (CEOE-Tenerife) were consulted. Allegations of opposition or caution were presented:

  • CEOE-Tenerife, with contributions from FAUCA and ASUICAN (July 22, 2026), questioned that the municipal report is based on aggregated data for the municipality as a whole and not on an individualized analysis of the excluded areas.
  • CCOO (July 27, 2026) warned of the effects on Sunday rest, family and work-life balance, and small local businesses.
  • The Official Chamber of Commerce of Santa Cruz de Tenerife (July 27, 2026) demanded objective and proportional justification, including data on overnight stays and accommodation capacity.

The resolution dismisses these observations: it emphasizes that the measure does not impose mandatory opening on Sundays and holidays, but rather expands the margin of freedom for each establishment, and that article 12.4 does not require the cumulative concurrence of all provided circumstances. The Guía de Isora City Council responded to the allegations on August 28, 2026, arguing that the tourist reality of the municipality must be assessed in an integrated manner.

Validity and means of appeal

The extension is projected for the entire year and will remain effective as long as the tourist, commercial, residential, and socioeconomic circumstances that justify it persist, without prejudice to its review, modification, or revocation. Against the resolution, which ends the administrative process, an optional appeal for reversal may be filed before the Vice-Ministry of Industry, Commerce, and Consumption within one month, or a contentious-administrative appeal before the Contentious-Administrative Chamber of the High Court of Justice of the Canary Islands in Santa Cruz de Tenerife within two months.

The decision directly affects businesses, staff, and visitors in the south of Tenerife: establishments throughout the municipality, and not only those on the coast, may open on Sundays and holidays if they so decide, which homogenizes competition conditions between centers and adjusts the commercial offer to a tourist and residential demand that is no longer concentrated solely on the coast.
