Fuentes de León approves the ordinance for street closures for the hospitality sector
Por FactBox Admin

The City Council of Fuentes de León (Badajoz) has made final the Ordinance regulating the temporary closure of public roads linked to hospitality establishments, as no claims were filed during the public exhibition period. The provisional plenary agreement, adopted on August 26, 2026, is thus automatically approved as final, and its full text is made public in the Official Gazette of the Province of Badajoz No. 202, dated October 21, 2026, under the reference Announcement 4157/2026. The regulation affects bars, restaurants, and residents of the municipality, who will see the temporary occupations and closures of streets linked to hospitality activities regulated.
The procedure began with the agreement of the municipal Plenary dated August 26, 2026, which initially approved the ordinance in accordance with articles 49 and 70.2 of Law 7/1985, of April 2, regulating the Bases of the Local Regime, and article 56 of the consolidated text of the Local Regime. That agreement was subject to public information for thirty days from the day following its insertion in the gazette, as stated in Announcement 3430/2026, published in the Official Gazette of the Province of Badajoz No. 167, dated September 1, 2026.
During that period, the file could be examined at the municipal offices and on the City Council’s Electronic Office (http://fuentesdeleon.sedelectronica.es). The September announcement warned that, if no claims were presented within the stated period, the agreement would be understood as definitively approved. This has occurred, and the text now integrates into the municipal legal framework without the need for a new plenary pronouncement.
From the provisional agreement to the final text
Announcement 4157/2026 confirms that no allegations were registered and that, therefore, the plenary agreement of August 26 “is automatically elevated to final.” The document is published in the Local Administration section, City Councils subsection, of the provincial gazette of October 21.
The full text of the ordinance is not reproduced in the gazette: the City Council indicates that it is available for examination by any interested party on the transparency portal of the municipal Electronic Office. The publication thus serves the function of making the agreement known and opening the path for challenge.
A municipal fee associated with the closures
The ordinance is accompanied by a tax modification processed in parallel by the same Plenary on August 26. Announcement 4144/2026, published in the Official Gazette of the Province of Badajoz No. 201, dated October 20, 2026, definitively approves the modification of the Fiscal Ordinance regulating the fee for the occupation of public roads with construction materials, rubble, scaffolding, street closures, and other analogous installations.
The stated objective of this modification is to incorporate the new fee for temporary street closures requested by hospitality establishments in the municipality. To this end, a new concept is introduced into the fee table, and the regulatory articles governing accrual and management are adjusted. The current tax regulation being modified is the one published in the Official Gazette of the Province of Badajoz No. 251, dated December 31, 2007.
Deadlines and means of appeal
The agreement now being published exhausts the administrative route, meaning it may be challenged directly before the courts. The deadlines and the competent body are as follows:
- Contentious-administrative appeal before the Contentious-Administrative Chamber of the High Court of Justice of Extremadura.
- A period of two months starting from the day following the full publication of the ordinance in the provincial gazette.
- Legal basis: articles 10.1.b) and 46.1 of Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction.
- Text consultation: transparency portal of the Electronic Office of the Fuentes de León City Council.
The announcement is signed by the mayor-president, Ana Fernández-Salguero Elena, as of the date of the digital signature.
An August plenary session with several regulations
The plenary session of August 26, 2026, was particularly productive regarding regulations for the municipality. In addition to this ordinance and the tax modification, the Plenary initially approved the Municipal Action Plan for the risk of forest fires, which was also made final and published in the Official Gazette of the Province of Badajoz No. 201, dated October 20, 2026 (Announcement 4136/2026).
In the same session, it was agreed to delegate to the Mayor’s Office the processing and awarding of the concession file for the cafeteria-bar services of the Las Cuevas natural monument, according to Announcement 3438/2026, disseminated in the Official Gazette of the Province of Badajoz No. 179, dated September 18, 2026.
The entry into force of the ordinance provides its own regulatory coverage for a widespread practice in the municipality and allows the City Council to organize the temporary street closures requested by bars and restaurants, with an associated specific fee. For residents, the framework sets out the conditions of these occupations in writing; for hospitality operators, it clarifies the application process and the associated cost.
