Francisco de Orellana regula la adjudicación de predios del barrio Flor de Oriente

The Municipal Council of the Autonomous Decentralized Municipal Government of Francisco de Orellana approved Municipal Ordinance OM-013-2026, which regulates the adjudication procedure for municipal properties classified as private domain assets of the First Stage of the Flor de Oriente neighborhood, located on the consolidated urban polygons PMO1 and PRO1. The regulation was sanctioned on September 22, 2026, by Mayor Shirma Consuelo Cortés Sanmiguel and published in the Official Registry, Special Edition No. 1676, on Friday, October 2, 2026, in the municipal ordinances section.

From the judicial sentence to the municipal title

The ordinance closes a judicial process spanning more than a decade. Through a sentence dated March 11, 2015, the Specialized Civil and Commercial Chamber of the Provincial Court of Justice of Pichincha, within process No. 17113-2013-0458, ordered the company INSERPETRO Cía. Ltda. to transfer the ownership of 100.31 hectares of the Flor de Oriente neighborhood, in the Francisco de Orellana canton, to the Ecuadorian State, and stipulated that said sentence serve as the title for registration.

A court order dated November 21, 2025, from the Civil Judicial Unit based in the Iñaquito parish, in process No. 17307-2008-0910, ordered that the property be transferred to the name of the Autonomous Decentralized Municipal Government of Francisco de Orellana representing the State. The sentence and the court order were notarized on May 5, 2026, at the Third Notary Office of the Francisco de Orellana canton, and on May 6, 2026, the Property Registry registered the transfer under entry No. 923-2026. On June 23, 2026, entry No. 1383-2026 registered the unification of lots four and five into a single property body, Lot FOUR-FIVE, with cadastral key 2201500303097002 and a total surface area of 1,088,298.13 m².

Approved census and requirements for possessors

On July 14, 2026, the Municipal Council approved the census and the planimetry of the First Stage through Resolution GADMFO-CM-2026-115, based on REPORT-GADMFO-DOT-WR-2026-036 from the Directorate of Territorial Planning. The ordinance warns that appearing in the census does not grant automatic ownership or a subsidy.

To request adjudication, the beneficiary must submit the following at the designated municipal window:

  • Copy of citizenship ID and current voting certificate with residency in the canton.
  • Factory line form and certificate of no debt to the municipality.
  • Sworn statement of not being a beneficiary of previous adjudications nor holding ownership over other urban properties in the canton.
  • Death certificate and kinship certificate, in the case of successors or legal heirs.
  • Email and telephone number for notifications.

Those who are not residents of the canton, are authorities, municipal officials or employees, have pending litigation regarding the property, hold illegitimate possession, or submit false documentation are disqualified. Each family nucleus may receive only one subsidized property.

Subsidy of up to 99% and processing deadlines

The value of the property will be set according to the current cadastral appraisal. Beneficiaries in extreme poverty or poverty accredited in the Social Registry will directly access a 99% subsidy. For the rest, the Social Development Directorate will calculate a Payment Capacity Index (PCI) that combines monthly household income (60%) and assets (40%), with decreasing subsidies from 99% to 70%.

The procedure includes a building line inspection, a risk certificate from the Risk Directorate, a socioeconomic report, payment, and a resolution from the highest executive authority. The awardee will have 90 non-extendable days to notarize and register the deed; otherwise, the resolution will cease to have effect. The awarded properties will be established as family assets and may not be alienated for ten years.

Second stage excluded and one-year deadline

The ordinance is limited to the First Stage and expressly excludes polygon PEU01, corresponding to rural land for urban expansion. No authority may extend the regime by analogy, and its eventual regularization will require a change in land category and an independent regulatory reform.

The deadline to submit the single application for adjudication will be one calendar year counted from the business day following its promulgation, extendable only once for reasons of force majeure. Once the deadline has expired, properties without an application will remain under municipal ownership and custody.

The regulation was approved in the first debate on September 16, 2026, through Resolution GADMFO-CM-2026-144, and in the second and final debate on September 22, 2026, with Resolution GADMFO-CM-2026-151. The SOCIAL REPORT GADMFO-DDS-RASCH-2026-059 and the risk report GADMFO-DR-JAPYMR-2026-011 are an integral part of the ordinance.

The measure defines the legal security of hundreds of families who occupied and consolidated the neighborhood without registered titles, by opening an individual, traceable process with a subsidized price to regularize their housing. At the same time, it sets clear limits: it excludes risk zones, green areas, and public assets, prohibits new subdivisions and transfers of possession, and leaves out the second stage, whose regularization remains pending a subsequent territorial decision.
