Fomento abre a alegaciones el decreto de diseño de la vivienda protegida

The General Directorate of Housing and Architecture, under the Ministry of Development, Housing, Territorial Planning and Environment of the Government of Cantabria, has submitted for the joint process of hearing and public information the draft Decree approving the General, Design and Quality Ordinances for protected housing in Cantabria. The resolution is published in the Official Gazette of Cantabria number 205, dated October 26, 2026, with official reference CVE-2026-8281, and opens a period of ten business days to submit allegations.

The text is processed under Article 51.3 of Law 5/2018, of November 22, on the Legal Regime of the Government, the Administration and the Institutional Public Sector of the Autonomous Community of Cantabria, in relation to Article 133.2 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations. The regulation is intended to replace the current Order OBR/4/2007, of April 17, which until now established the general design and quality ordinances for protected housing in the community.

A new decree instead of a partial modification

The resolution signed by the director general, Carlos Montes García, in Santander on October 26, 2026, explains the change in the regulatory vehicle: in view of the scope of the proposed changes, the Ministry considers it “more appropriate to approve a new regulation that replaces Order OBR/4/2007, of April 17,” instead of undertaking a partial modification of the current order.

The department maintains that this option does not alter the content of the previous public consultation, published in the Official Gazette of Cantabria number 128, of July 4, 2025. According to the text, the same purposes, the problems intended to be solved, the necessity and opportunity of the regulation, its objectives, and the alternatives then evaluated are maintained; the change is limited to the way the regulation is articulated.

How and where to consult the text and submit allegations

The complete project will be available to the public under these conditions:

  • In-person consultation at the offices of the General Directorate of Housing and Architecture, calle Alta number 5, sixth floor, Santander, from 09:00 to 14:00 hours.
  • Electronic consultation on the Transparency Portal of the Government of Cantabria, at the address participacion.cantabria.es/normativa.
  • Period for allegations: ten business days starting from the day following the publication of the resolution in the Official Gazette of Cantabria.
  • Submission in writing addressed to the General Directorate of Housing and Architecture, at the locations provided for in Article 134.8 of Law 5/2018.
  • Electronic submission through the enabled box on the Transparency Portal, following the instructions provided therein.

The resolution further orders the publication of the agreement in both the Official Gazette of Cantabria and the Cantabria Transparency Portal, so that the procedure is documented in both official channels.

The framework: Law 5/2014 and the design of protected housing

The design and quality ordinances are the technical standard that specifies how housing subject to a protection regime must be designed and constructed. Their validity is intertwined with Law 5/2014, of December 26, on Protected Housing of Cantabria, which establishes the requirements and conditions for use and protectable surface area.

This link is explicit in the administrative practice of the regional Executive: in the processing of urban planning instruments, the regulatory documents must mention compliance with the legal minimum for protected housing and certify that the conditions set by Law 5/2014 and Order OBR/4/2007 are met, with a prior favorable pronouncement from the General Directorate of Housing and Architecture. The future regulation will precisely replace that technical reference in the planning files.

Impact for developers and awardees

The decree will affect public and private developers of protected housing, who must adjust their projects to the new design and quality parameters, and future awardees, who will see the conditions of the housing they receive fixed by regulation. It also conditions city councils and planning drafters, who are obliged to verify compliance with these ordinances in the approval of partial plans and other instruments.

With a deadline of ten business days, the margin for participation is limited: contributions must be submitted in writing and with justification to the General Directorate of Housing and Architecture, which must then incorporate or discard the allegations in the text submitted to the Governing Council. Furthermore, the regulation arrives in a context of pressure on protected residential land in Cantabria, where compliance with the legal minimums for protected housing is verified file by file.
