Corrigendum issued by Judge Varela Araya's chamber
Por FactBox Admin

Gazette No. 201 from Friday, October 23, 2026, published a corrigendum correcting Legislative Agreement No. 7129-26-27: the reelection of Julia Zoraida Varela Araya is as a magistrate of the Second Chamber of the Supreme Court of Justice, and not of the Constitutional Chamber. The rectification appears on page 2 of the official journal, under the heading Legislative Power, and is signed by Alejandra Bolaños Guevara, acting general manager of the National Printing Office, with official reference IN202601134650.
The original agreement had been published in Gazette No. 177, Supplement No. 126, on September 21, 2026. According to the now-corrected text, the reelection covers the period between September 16, 2026, and September 15, 2034, that is, the full eight years of the magisterial appointment.
The corrigendum does not modify the meaning of the decision nor the period of the appointment: it only replaces the name of the chamber to which the magistrate belongs, as it was a material error in the identification of the body.
What the text says and what should be read
The correction is formulated using the usual formula for these cases, reproducing the published passage and its correct version:
- Where it said: reelect Julia Zoraida Varela Araya as magistrate of the Constitutional Chamber of the Supreme Court of Justice, for the period from September 16, 2026, to September 15, 2034.
- It should read: reelect Julia Zoraida Varela Araya as magistrate of the Second Chamber of the Supreme Court of Justice, for the same period.
The notice specifies that the publication of September 21 contained “a material error in the name of the Chamber to which the magistrate belongs.” It is published only once, in accordance with the official journal’s practice for this type of rectification.
The weight of the chamber in the composition of the Judiciary
The difference between one chamber and another is not minor. The Second Chamber is the instance that handles labor matters within the Supreme Court of Justice, while the Constitutional Chamber exercises the control of constitutionality, including mandatory legislative consultation and the resolution of writs of amparo.
Hence, the rectification has a direct effect on the composition of the judicial leadership for the 2026-2034 period: it places Varela Araya within the labor sphere and clears up any doubt regarding the seat she would occupy in the constitutional court.
This detail is also important because the composition of the chambers is defined by legislative agreements that citizens consult as a primary source, and an error of this nature in the official journal forces legal practitioners to verify the rectified version before invoking it.
Other corrections in the same edition
Page 2 of Gazette No. 201 contains several corrigenda, in addition to that of the legislative agreement:
- Supreme Tribunal of Elections: the edict published in Gaceta No. 40 on February 27, 2026, naturalization file No. 439-2026, is corrected, where “Deimante Gregeryte Gregeryte” was recorded and the correct name is “Deimante Gregeryte” (reference IN202601134657).
- Santiago Paraíso Aqueduct and Sewerage Administration Association, legal entity ID 3-002-306104: it is clarified that the lost book is the Journal volume 2 and that the book to be legalized is the Journal volume 3 (reference IN202601134422).
In both cases, these are clerical errors, the same category that prompted the rectification of the agreement regarding the magistrate.
Impact for readers
For lawyers, litigants, and judicial officials, the correction establishes the official version that must be cited: whoever invokes Legislative Agreement No. 7129-26-27 must refer to the Second Chamber and not the Constitutional Chamber, with a period extending until September 15, 2034. The erratum thus closes a discrepancy that, if maintained, would have altered the reading of the composition of the Supreme Court of Justice over the next eight years.
