Fageca extends the suspension of licenses to all tourist accommodation

The Fageca City Council has extended the precautionary suspension of tourist licenses to all types of accommodation, according to the Plenary agreement of September 14, 2026, published in the Official Gazette of the Generalitat Valenciana (DOGV) no. 10476, of October 22, 2026, in section V of announcements (reference DOGV-C-2026-29333). The measure expands the scope of the Tourist Resource Planning Plan (PORT) that the municipality has been processing since August and affects owners and developers throughout the entire municipal district.

The immediate precedent is the plenary agreement of August 7, 2026, which initiated the processing of the PORT as an ordinance under article 27 and the second additional provision of Law 15/2018, and precautionarily suspended licenses for new tourist dwellings. That first announcement was published in DOGV no. 10440, of August 31, 2026 (DOGV-C-2026-26661), with a public information period of thirty business days.

Now, the Plenary held on September 14 extends that scope, and the announcement bears the signature of the mayor-president, Ismael Vidal Soneira, dated in Fageca, September 15, 2026.

All typologies and the entire municipal district

The first point of the agreement extends the suspension ratified in August to the implementation of new tourist accommodations of all types:

• Tourist dwellings.
• Rural houses and other rural tourist accommodation (articles 64 to 67 of Decree 10/2021).
• Tourist apartments.
• Hotel establishments.

The territorial scope is the entirety of the municipal district of Fageca, including the conversion of existing properties to those uses and changes of use aimed at such purposes.

What remains suspended and what does not

The second point suspends the granting of urban compatibility certificates and reports, licenses, changes of use, and the admission of responsible declarations aimed at the implementation of the indicated typologies. The suspension takes effect from the date of the agreement and conforms to the duration and terms of article 68 of the TRLOTUP.

The third point expressly excludes from the scope of the suspension:

• Housing rentals and rentals for uses other than housing or seasonal rentals regulated in Law 29/1994 on urban leases.
• Any residential use, as it is not subject to municipal intervention.

Furthermore, the fourth point maintains the duty to process and resolve on the merits the applications submitted before the agreement, regardless of their typology, in accordance with article 21 of Law 39/2015, with strict requirement of the legal prerequisites applicable to each.

Planning plan and allegations

The fifth point expands the scope of the PORT currently under processing to the regulation of all types of tourist accommodation, with the specific motivation corresponding to each one, and mandates the adaptation of the technical report and the instrument’s documentation to this new scope.

The sixth point orders the publication of the agreement in the Official Gazette of the Province of Alicante, on the notice board, and on the electronic headquarters and, for the purposes of article 68.4 of the TRLOTUP, in the DOGV; to communicate it to the department of the Consell competent in tourism matters; and to authorize the Mayor’s Office for whatever actions may be necessary.

With the publication, a public information period of thirty business days is opened, counted from the day following the insertion of the announcement in the DOGV, so that those who may be considered interested parties may appear and submit allegations, suggestions, or claims.

The scope of the decision is relevant for the municipality: the suspension puts on hold, for now, any tourist accommodation project—including hotels, apartments, and rural houses, not only tourist-use dwellings—throughout Fageca, while the instrument that will establish the compatibility of use by zone and, where applicable, the maximum number of accommodations is drafted.
