Estepa extends its housing plan to adapt it to Law 5/2025
Por FactBox Admin

The Plenary of the Estepa City Council unanimously approved, by the 17 councilors in attendance, the extension of the municipality’s Municipal Housing and Land Plan and expressly declared its transitional validity and ultra-activity. The agreement was adopted in an ordinary plenary session on September 29, 2026, under the ninth item of the agenda, and is published in the Official Gazette of the Province of Seville number 212, dated November 3, 2026, on page 43 (official reference BOP-SE-2026-212010). The document is signed by the mayor-president, Antonio Jesús Muñoz Quirós, with an electronic signature date of October 21, 2026.
The extended plan had been approved following its publication in the BOP of Seville number 226, dated September 28, under the now-repealed Law 1/2010, of March 8. The corporation now expressly declares its continued validity to comply with the obligation set forth in Article 19 of Law 5/2025, of December 16, on Housing of Andalusia, in everything that does not contradict the new regional framework.
Transitional validity until the final revision
The municipal agreement maintains that the plan retains “its full legal efficacy as a programmatic, justificatory, and enabling instrument” for the council’s actions regarding housing and land. According to the approved text, this efficacy extends to applying for financing programs and public subsidies, and will be maintained until the final approval of the revision, update, and adaptation of the document to the regulatory framework of Law 5/2025.
The chosen formula combines two figures: the extension of the current planning and the declaration of ultra-activity—that is, the survival of its effects once the legal framework in which it was born has been replaced. The Plenary thus supports the continuity of the instrument while its replacement is processed, avoiding a vacuum in the municipality’s housing and land planning.
Technical assignment for the new drafting
In a second point of the operative part, the corporation urges the mayor-president to initiate the necessary administrative file to promote the revision, update, and adaptation of the plan to Law 5/2025. The assignment for drafting the revision document falls to the Technical and Legal Services of the city council’s Urban Planning Delegation.
The agreement also empowers the mayor, where applicable, to process technical assistance contracts or other management acts that may be necessary to complete said drafting. The text does not set specific deadlines or a calendar for the approval of the new document.
Publication, notification, and access
The operative part orders the publication of the plenary agreement in the Official Gazette of the Province of Seville, on the Notice Board, and on the Transparency Portal of the Estepa City Council, “for general knowledge and legal effectiveness against third parties.”
It also provides for its formal notification to the Territorial Delegation of Development, Territorial Articulation and Housing in Seville and empowers the Mayor’s Office to carry out whatever acts and signing of documents be necessary for its execution. The document remains available to interested parties on the municipal electronic office.
Impact for residents
The extension clarifies the municipality’s position before the regional Administration and regarding calls for aid: without a current housing and land plan, it is not possible to apply for financing programs and public subsidies that require such an instrument. For residents of Estepa, the agreement means that the housing planning determinations remain applicable—including land reserves and action programs—while the city council drafts the adaptation to the 2025 Andalusian regulation.
