Esbjerg court declares City Restaurant ApS bankrupt; creditors get four weeks

City Restaurant ApS, a restaurant company registered at Tarphagevej 53 in Esbjerg V, was taken into bankruptcy by decree of Retten i Esbjerg (the District Court of Esbjerg) on 21 October 2026. The decree was published in Statstidende on 23 October 2026 under reference S21102026-26, in the bankruptcy notices of section I. Anyone holding a claim against the company has four weeks from publication to report it to the appointed curator, Corna Levin Munch.

The bankruptcy follows a petition received by the court on 9 October 2026, roughly two months after the company entered compulsory dissolution. The decree records that City Restaurant ApS had been under compulsory dissolution (tvangsopløsning) since 19 August 2026, the procedure used when a company fails to comply with statutory filing obligations. The case is registered as SKS 15-295/2026.

The terms of the decree

The announcement identifies the debtor and the procedural framework as follows:

  • Debtor: City Restaurant ApS, CVR no. 45240738
  • Registered address: Tarphagevej 53, 6710 Esbjerg V
  • Court: Retten i Esbjerg, bankruptcy division (skifteret)
  • Case number: SKS 15-295/2026
  • Decree date: 21 October 2026
  • Petition received: 9 October 2026
  • Compulsory dissolution in force since: 19 August 2026
  • Curator: attorney Corna Levin Munch, Bavnehøjvej 5, 6700 Esbjerg

The decree is signed by the court in Esbjerg and lists the curator and the bankruptcy division as the two contact points for the estate.

Two deadlines for creditors and for the estate’s governance

The notice sets out two separate windows, both counted from the date of publication on 23 October 2026:

  • Four weeks for any person holding a debt or other claim against the debtor to report that claim to the curator, quantified as at 21 October 2026 and accompanied by supporting documentation.
  • Three weeks for any request that a curator or a creditors’ committee be elected, which must be submitted in writing to the bankruptcy division of Retten i Esbjerg.

The distinction matters: the shorter deadline governs who administers the estate, while the longer one governs who is counted as a creditor in it.

A recurring curator on the Esbjerg docket

Corna Levin Munch is named as curator in several other Esbjerg decrees carried in the same 23 October issue of Statstidende, including that of SlumDuck ApS (CVR no. 42896152) of Surhavevej 24, 6650 Brørup, case SKS 15-298/2026, also decreed on 21 October 2026 after a petition received the previous day. That company had likewise been under compulsory dissolution, since 13 August 2026. The 23 October issue carries more than forty bankruptcy decrees dated 21 October, a volume that reflects the routine, high-turnover nature of these announcements rather than any single event.

For suppliers, landlords, staff and other counterparties of City Restaurant ApS, the practical consequence is that the company’s affairs now sit with the curator rather than with its management. Claims are to be addressed to Bavnehøjvej 5 in Esbjerg, not to the restaurant’s former premises, and the four-week window that closes in late November is the point at which the estate’s creditor list is fixed.
