The Order of September 25, issued by the Minister of Security Bingen Zupiria Gorostidi, has modified the list of positions of the Ertzaintza. The change was published in BOPV number 210 on November 3, 2026, with official reference 2026/4627, and will enter into force on November 4, the day after the publication. The text eliminates the Eten service, creates the head of Violence Against Women and Equality, and inserts the scale of faculty and technical staff into the list.

Development of an order that changed the structure

The list of positions of the Ertzaintza was approved by the Order of December 31, 1997 (BOPV 250, December 31), and since then it has been continuously adapted to structural changes. The orders of March 12 and November 6, 2015 (BOPV 54 and BOPV 218) consolidated the structure as a result of the Horizonte-2016 strategic plan, and between 2017 and 2025, fourteen orders updated the list, the last one being February 19, 2025 (BOPV 39, February 26) and its correction (BOPV 55, March 20).

The last step was the Order of July 29 (BOPV 157, August 19): it added new heads and areas to the structure and removed the Eten service. The now-published order implements those decisions with endowments, remuneration, and language profiles. The Minister himself signs the text, having received the report of the Ertzaintza Council and conducted the negotiation of the table under Article 125 of the consolidated text of the Police Law, with the competence granted by Article 4.2.h of Decree 318/2024.

Elimination of the Eten service and creation of a new head

The first annex amortizes positions. Among them are nine endowments of the Eten service:

Code 21425, ETEN non-commissioned officer, Oiartzun: one endowment is eliminated.
Code 21426, ETEN agent, Oiartzun: eight endowments are eliminated.

According to the August order, these tasks will be taken over by specialist road safety workers in the territorial traffic units. In the same annex, the position for the promotion of equality and diversity (10012) which was in the Intendant category, as well as several positions in the Spokesperson, Communication and Protocol service, are also removed.

The second annex creates new positions. The head located in Erandio has eight endowments:

Head’s directorate, in the commissioner category: one endowment.
Officer category: one endowment.
First category agent: two endowments.
Agent category: four endowments.

The structure approved in August established two sections: Training, Regulation and Victim Protection, on one hand, and Coordination, Cooperation and Equality, on the other.

Strategic Planning Area and new scale

Alongside the leadership, the Strategic Planning Area receives nine allocations: one head in the official category (10013), one group leader in the non-commissioned officer category (10014), and seven agents (10015). According to the structural order, this area is the technical body for continuous improvement and the monitoring of the Strategic Plan.

The scale of facultatives and technicians is also included in the list, complying with the final provision of Decree 156/2022, and is distributed across several units:

Scientific Police: twelve specialist technicians in Forensic Genetics, six in Chemistry, six in New Technologies, and two in Forensic Anthropology.
Cybersecurity leadership: five allocations in the fields of Intellectual Property and Hacking.
Criminal Investigation: Heritage and Financial Analysis (two allocations) and Environmental Damage Assessment (two allocations).
Spokesperson, Communication, and Protocol: two allocations in the field of audiovisuals.

Remuneration is established according to article 120 of Law 11/2022, article 115 of the consolidated text of the Police Law, and article 7 of Decree 298/1997.

Execution of judgments and other changes

The order executes judgment 356/2025, dated December 12, 2025, issued by the Court No. 1 of Administrative Litigation of Vitoria-Gasteiz in summary procedure 423/2023. As a result, one allocation for position 40114 is created, in the official category, with the specialty of the Mobile Brigade course and located in Iurreta.

Allocations are increased in several other units: traffic agents in Oiartzun (fifteen more), Citizen Security in Muskiz (ten more), cybersecurity agents (four more) and one non-commissioned officer, and Criminal Investigation agents in three territorial headquarters. The fourth annex establishes new dates for fulfilling the language profile, most of them June 4, 2026, and the fifth publishes the complete updated list of Ertzaintza positions.

Impact

The Ertzaintza will have the new staff structure in effect from November 4, and the changes directly affect both the internal organization and working conditions: some units disappear and new positions are created, including the scale of facultatives and technicians with new remunerations. The decision was taken through an order that exhausts the administrative route, and a one-month appeal may be filed against it before the Secretary of Security, or a two-month appeal before the Court of Administrative Litigation.
