Elche emplaza a la plantilla de Torrevieja en el pleito de productividad

The Contentious-Administrative Section of the Court of First Instance of Elche, Court No. 2, has summoned the entire staff of civil servants and contractual personnel of the Torrevieja City Council to appear as defendants in the abbreviated procedure 374/2026, filed by the C.C.O.O. Trade Union Confederation of the Valencian Country against the modification of the Regulatory Agreement of the Productivity Supplement. The summons is notified via an announcement from the Torrevieja City Council published in the Official Gazette of the Province of Alicante number 204, dated October 27, 2026, section III (Local Administration), page 1, with reference 8088.

The challenged act and its administrative chain

The appeal is not directed against the original wording of the agreement, but against the municipal response to the union’s prior challenge. The announcement identifies the challenged action as the Agreement of the Plenary of the Torrevieja City Council of June 29, 2026, file 77132/2026, which dismissed the optional appeal for reversal filed by CCOO.

That appeal for reversal was, in turn, directed against the Plenary Agreement of March 30, 2026, which approved the modification of the Regulatory Agreement of the Productivity Supplement for personnel in the service of the Torrevieja City Council. The judicial route arrives, therefore, after the discussion at the municipal level has been exhausted: first the modification approved in March, then the attempt to reverse it via an administrative appeal, and finally, the dismissal in June.

Nine days to appear and who is called

The summons is issued in accordance with articles 48 and 49 of Law 29/1998, of July 13, regulating the contentious-administrative jurisdiction. The deadline and conditions are as follows:

  • Nine days to appear, counted from the day following the publication of the announcement in the Official Gazette of the Province of Alicante.
  • The appearance is made in the capacity of defendants, “if it is in their legal interest.”
  • Representation is mandatory in the form established in articles 23.2 and 23.3 of the same jurisdictional law.
  • Those called are the persons whose rights and legitimate interests could be affected by the granting of the plaintiff’s claims.

Affected parties: the entire staff, without distinction

The summoned group is not limited to a specific body or category. The announcement identifies as interested parties the entirety of the civil servant and contractual personnel in the service of the Torrevieja City Council, which turns the litigation into a matter that reaches the entire municipal personnel structure and not only the current recipients of the supplement.

The document is electronically signed by the Mayor-President of the Torrevieja City Council, acting as the publishing body for the summons agreed upon by the court of Elche.

Why it matters

The judicial resolution does not anticipate the outcome of the ruling, but it establishes a peremptory schedule: any municipal worker wishing to defend their position in the lawsuit regarding the productivity supplement must appear within nine days or will remain outside a controversy that could redefine how performance and initiative are remunerated in the Torrevieja City Council. Furthermore, the conflict affects the relationship between the council and union representation, after the inadmissibility of the appeal for reversal closed the administrative route opened in March.
