El Papiol hires two emergency interim workers without advertising or competition

Por FactBox Admin

El Papiol contracta dos interins d'urgència sense publicitat ni concurrència

The City Council of Papiol has approved two temporary labor contracts through a “maximum urgency” procedure, with the direct preselection of one candidate and without prior advertising or competition. The two resolutions, mayoral decrees no. 0599D26 and no. 0631D26, are published in the Official Gazette of the Province of Barcelona on October 29, 2026, in the local administration section, under the official reference CVE 202610157739. In both cases, the hiring had already taken effect weeks before publication: September 21 and October 2.

The appointments are listed in a joint announcement from the council’s personnel department, which details for each case the selection file, the legal regime, the category, the reason for the substitution, and the salary level. The text stems from a numbered selection procedure—06/2026 and 13/2026—and ends in a temporary labor contract linked to filling a position that became vacant due to the absence of the titleholder. Neither of the two contracts has a fixed end date: both expire “once the substituted person returns.”

Two positions filled due to supervening absences

The first appointment affects Ms. Maria Fernanda Pruna Sarango, hired as labor personnel of salary group C1, mid-level technical personnel subscale. The reason is a temporary disability leave of the titleholder, and the employment relationship began effective September 21, 2026. The assigned position is EM89R and the assigned salary level is LC1CD17CE69. The selection file is E: 2026_1299, corresponding to procedure 06/2026, and the personnel file is E: 2026_2549.

The second affects Mr. Bartolomeo Barenghi, with a labor contract of salary group A1 and the category of senior technical personnel. In this case, the cause is the leave of absence of the titleholder and the hiring is effective from October 2, 2026. The position is EM79P, with salary level LA1CD25CE91, selection file E: 2026_2543 (procedure 13/2026) and personnel file E: 2021_601.

Direct preselection without any public announcement

The most relevant element of the two files is the system used. The bulletin describes the procedure literally as “maximum urgency (direct preselection system of a possible candidate without prior advertising or competition).” This means there was no public call, no deadline for submitting applications, nor a scoring of merits among several applicants: the council directly designated the two individuals.

Temporary staff selection processes in local administration must respect the principles of equality, merit, and capacity, and the urgent hiring route is reserved, in administrative practice, for cases where the immediate coverage of the service does not allow for the timeline of a competitive process. The announcement does not present any additional circumstances explaining why the urgency prevented the opening of the call, nor does it indicate whether generic service provision offers had been published previously.

Technical profiles and part-time schedules

Both hires are part-time, a circumstance that the document records under “notes and observations”:

  • Maria Fernanda Pruna Sarango: part-time schedule of 40.18%, group C1, middle technician, effective from 21.09.2026.
  • Bartolomeo Barenghi: part-time schedule of 61.61%, group A1, senior technician, effective from 02.10.2026.

Both positions are technical profiles and neither is equivalent to a command or management structure position, although the second does correspond to the highest qualification group in local administration (A1).

Pending publication and retroactive effects

The announcement adds a relevant formal detail: in both files, the “official publication” section indicates that the procedure is “pending publication in the BOPB and the DOGC,” despite the text already appearing published in the provincial bulletin on October 29. The decrees, therefore, were issued and executed before the official dissemination required for this type of personnel resolutions was completed.

The sum of these elements —direct appointment, absence of competition, retroactive effects of up to five weeks, and publication described as pending— makes the announcement a case susceptible to questioning by trade union organizations or municipal opposition groups, who could request the selection file to verify how the two candidates were chosen.

For the readers of Papiol, the information is doubly useful: on one hand, it identifies two people who already provide service to the city council and the positions they occupy; on the other, it provides documentary evidence of a hiring method that reduces the guarantees of equal access to public employment in a small municipality, where these types of positions are often filled without any visible competitive process.
