El Gobierno canario modifica el Plan de Ordenación del Personal Laboral autonómico

The Government of the Canary Islands has authorized the formalization of the agreement reached on September 18, 2026, in the Negotiating Commission of the Third Collective Agreement to modify the Personnel Organization Plan for Labor Staff in the service of the Public Administration of the Autonomous Community. The decision was adopted in the Executive session on October 19, 2026, and is published in the Official Gazette of the Canary Islands no. 215, of October 27, 2026, section III (Other Resolutions), by resolution of the General Secretariat of the Presidency of the Government (reference 3702, page 38803).

The Personnel Organization Plan had been approved by agreement of the Government of the Canary Islands on April 13, 2026, under article 69 of the consolidated text of the Law of the Basic Statute of the Public Employee, approved by Royal Legislative Decree 5/2015, of October 30. The text was the result of collective bargaining carried out within the Negotiating Commission of the Third Collective Agreement, following the establishment of a technical table between the Administration and the unions representing the labor staff.

According to the now-published agreement, after the signing of the Plan, the need for a specific modification in the composition of the Monitoring Commission and the Working Groups was established, in order to guarantee the exercise of the rights recognized in articles 6 and 7 of Organic Law 11/1985, of August 2, on Trade Union Freedom. The Executive emphasizes that the proposals of these bodies must, in turn, be submitted to the mandatory negotiation in the corresponding area, where said precepts likewise apply.

A correction limited to the eighth clause

The annex of the agreement contains a single point of modification: the new wording of the eighth clause of the Plan in its sections 1, 2, and 3. The first of these defines the Joint Monitoring Commission, whose purpose is to ensure the monitoring and development of the Organization Plan.

The change does not alter the actions already carried out: the agreement fully preserves the deliberation and analysis work carried out by the Monitoring Commission and the Working Groups prior to the modification.

Distribution of voices between unions and Administration

The new clause establishes the distribution of members in the joint body:

  • On behalf of the trade union organizations, the commission will include as many members as there are organizations present in the Inter-Center Committee.
  • Additionally, one member will be added for each trade union organization that, while not present in that body, meets the requirements of articles 6 or 7 of Organic Law 11/1985.
  • On behalf of the Administration, there will be a maximum number of representatives equivalent to the number of union representation.
  • In any case, the heads of the General Directorate of the Civil Service and of Planning and Budget will be part of it, along with four additional representatives.

Formalization, deposit, and retroactive effects

The agreement of the Government of the Canary Islands orders a specific sequence of procedures:

  • The authorization will be formalized through the signing of a minute between the head of the General Directorate of the Civil Service and each of the trade union organizations represented in the Negotiating Commission.
  • The minute must, in any case, include the signatures of the presidency and the secretariat of the Inter-Center Committee.
  • The General Directorate of the Civil Service will carry out the actions before the General Directorate of Labor for the registration and deposit of the agreement.
  • The modification will be applied with effect from September 18, 2026.

The Government relies on article 5 of Law 2/1987, of March 30, of the Canarian Civil Service, which attributes to it the direction of personnel policy and the competence to give validity and effectiveness to agreements through express and formal approval. Article 6 of the same regulation reserves for the head of the department competent in public employment the proposal to the Government of agreements regarding personnel matters. The proposal was submitted by the Minister of Presidency, Public Administrations, Justice and Security, following reports from the General Directorate of the Civil Service and the Preparatory Commission for Government Affairs.

The resolution is signed in the Canary Islands on October 19, 2026, by the Secretary General, Ceferino José Marrero Fariña. The text also provides for its dissemination on the personnel web portal of the General Directorate of the Civil Service.

The modification affects the body that monitors the application of the Labor Personnel Planning Plan, such that the composition of the board that oversees the staff, conditions, and professional development of the regional labor personnel is redefined with effect from September. The agreement comes just six months after the approval of the Plan and expands the presence of trade union organizations, including those not seated on the Inter-Center Committee but with rights recognized by union law.
