El Gobierno aprueba el registro estatal único de producción y gestión de residuos

The Council of Ministers approved Royal Decree 764/2026, of September 30, which regulates the Registry of waste production and management, a regulation that develops article 63 of Law 7/2022, of April 8, on waste and contaminated soils for a circular economy. The text is published in the Official State Gazette (BOE) no. 243, of October 1, 2026, section I, pages 128405 to 128417, with the official reference BOE-A-2026-20388. The regulation enters into force the day following its publication, that is, October 2, 2026.

The Registry is unique throughout the national territory and shared by all public administrations competent in waste matters. Its origin lies in Directive 2008/98/EC, which required Member States to maintain a register of entities that collect or transport waste professionally, dealers, brokers, and other companies exempt from authorization, and in Directive (EU) 2018/851, which reinforced traceability mechanisms through electronic registries. Transposition occurred first with Law 22/2011, of July 28, and later with Law 7/2022, of April 8.

The Ministry for the Ecological Transition and the Demographic Challenge began in 2013, through the Coordination Commission on Waste, the design of the electronic Waste Information System (eSIR) and the Registry itself, using an exchange language called “E3L”. According to the preamble, the Registry is already operational and has accumulated more than 450,000 entries, including contact details, location, treatment operations, EWC codes, and treatment capacities. The regulation is approved at the proposal of the Third Vice President of the Government and Minister for the Ecological Transition and the Demographic Challenge, Sara Aagesen Muñoz, in accordance with the Council of State and following deliberation by the Council of Ministers on September 29, 2026; the text was sanctioned by Felipe R. on September 30, 2026.

Three hierarchical levels and one identifier per center

The royal decree consists of nine articles, two additional provisions, one transitional provision, two final provisions, and an annex. Article 5 organizes the information into three hierarchical levels:

  • Entity: any natural or legal person involved in the waste production and management chain, uniquely identified by their NIF (Tax Identification Number).
  • Center: technical unit or registered office, uniquely identified by its Environmental Identification Number (NIMA), consisting of ten digits, assigned by the autonomous community.
  • Entry: coding associated with a center, identified by type and number, which corresponds to each prior notification or authorization.

The annex includes a non-exhaustive list of registration types, including those for agents (A01, A02), treatment managers (E01, E02), management centers (G01, G02, G04, G05, G06), brokers (N01, N02), producers (P01 to P05), mobile treatment facilities (PM), carriers (T01, T02), and extended producer responsibility systems (SIR and SCR).

Deadlines, obligated parties, and optional regime

The autonomous communities and the cities of Ceuta and Melilla are the competent entities to incorporate into the Registry the prior notifications and authorizations derived from Law 7/2022. The incorporation period may not exceed fifteen days from the registration in the corresponding regional registry. The management of the Registry corresponds to the Sub-Directorate General for Waste of the Directorate General for Environmental Quality and Assessment of the Ministry for the Ecological Transition and the Demographic Challenge.

Registration shall be optional for producers of non-hazardous waste who generate 1,000 tons per year or less and for waste holders. Holders may request the rectification of inaccurate or incomplete data from the autonomous community, and cancellations due to cessation of activity or change of activity must be communicated within the same fifteen-day period.

Public access and regional adaptation

The competent bodies of the autonomous communities, their inspection and surveillance services, and the Security Forces and Corps shall access the content of the Registry through eSIR. The public shall access basic public data by electronic means, while personal data shall remain protected in accordance with Organic Law 3/2018 and Regulation (EU) 2016/679. The public content shall be determined by ministerial order.

The sole transitional provision sets a deadline of twelve months from the entry into force for the autonomous communities and the cities of Ceuta and Melilla to adapt the information in their databases to the structure and content of the Registry. The regulation is issued under article 149.1.23. of the Spanish Constitution.

The new framework affects the entire industrial and waste management sector: collection and transport companies, brokers, agents, treatment managers, and extended producer responsibility systems must operate with homogeneous registrations across the country. The homogenization of data will allow administrations to validate transfers, monitor compliance, and consult a single system to see who is authorized to treat each type of waste, with special attention to hazardous waste.
